By virtue of that certain Deed of Trust made by Karen Hockenberry, to John E. Gompers, Trustee, dated the 27th day of May, 2005, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, on the 31st day of May, 2005, in Deed of Trust Book No. 751, at page 271, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 21st day of December, 2015, at 10:15 o’clock A.M., at the front door of the Marshall County Courthouse, Moundsville, West Virginia, the following described property (“Property”) situate at 20 Hockenberry Lane, Dallas, Marshall County, West Virginia 26036, and being more particularly described as follows:
The following described certain parcel of land, situate upon the northern margin of McCausland Hill Road, (Marshall County Route No. 24) located in the Sand Hill District of Marshall County, West Virginia, bounded and being more particularly described as follows:

Beginning at a point in the center of McCausland Hill Road at its intersection with the most easterly corner of a 5.10 acre parcel of land that was conveyed to Michael Shane Ullom by deed dated June 2, 2000, and of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia in Deed Book 614, at Page 269.

Thence, from the said place of beginning, leaving the lands of the said 5.10 acre parcel, and with the center of the said road, N. 63* 33′ 35″ E. for a distance of 166.74 feet to a point. Thence, leaving the said road, and through the lands remaining to the grantors herein, N. 16* 59′ 08″ W. passing on line an iron bar set at 30.00 feet, passing on line an iron bar set at 96.25 feet, for a total distance of 225.00 feet to an iron bar set. Thence, with same, S. 62* 16′ 42″ W. for a distance of 230.87 feet to a set iron bar located in the previously mentioned easternmost line of the said 5.10 acre parcel. Thence, with the lands of the said Ullom, S. 33* 34′ 13″ E. for a distance or 218.47 feet to the place of beginning, containing 1.00 acres, more or less, as shown upon a plat attached hereto and made a part of this description.

The above described 1.00 acre parcel of land is subject to a right-of-way for the purpose of ingress and egress for their heirs and assigns, over and upon an existing roadway leading from McCausland Hill Road, through the above described 1.00 acre parcel, to the lands remaining to the grantors herein. Said right-of-way is 20.00 feet wide, the centerline is more particularly described as follows:
Beginning at a point located N. 63* 33′ 35″ E. a distance of 25.00 feet from the said point of beginning for the above described 1.00 acre parcel. Thence, from the said place of beginning, and with the said centerline for the following two bearings and distances, N. 13* 33′ 35″ E. for a distance of 51.41 feet to a point. Thence, N. 54* 24′ 05″ E. for a distance of 119.96 feet to a point in the east line of the above described 1.00 acre parcel. Said point is located N. 16* 59′ 08′ W, a distance of 59.28 feet from the easternmost corner of the above described 1.00 acre parcel.

Being the same property conveyed to John E. Gompers by Karen Hockenberry, by Deed of Trust dated the 31st day of May, 2005, and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 751, at page 271.

The above described parcel of land is subject to right-of-way for that part of McCausland Hill road that is included herein.

This conveyance is, however, subject to the exceptions, reservations, covenants, conditions, restrictions and easements, if any, granted by or acquired from the parties of the first part and their predecessors in title to said land.

The above described property is known for street numbering purposes: 20 Hockenberry Lane, Dallas, WV 26041.

TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property
