NOTICE OF TRUSTEE’S SALE is hereby given
pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated
June , 13, 2017
executed by Borrower(s),
Mary Anne Carter, to
Catrow Law PLLC, the Trustee of record in the office of the Clerk of the County Commission of Berkeley County, West Virginia, in Book 3163, at Page 204. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Drive, Mar128 Fenwick Drive, Martinsburg, WV 25405. Pill & Pill, PLLC were appoited as Substitute Trustees by APPONTMENT OF SUCCESSOR TRUSTEE dated May 12, 2021, or record in the Clerk’s Office in Book 3711, Page 86. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Berkeley County, in Martinsburg, West Virginia, on the following date:

All that certain lot or parcel of real estate, with the improvements and appurtenances thereunto belonging, situate in the Arden District, Berkeley County, West Virginia, and more particularly described as follows:
Lot No. 32 and the southern one-half of Lot No. 33, Section A of Hillcrest Heights, as set forth in that certain plat prepared by J. B. Ferguson Engineers, fdated September 21, 1972 and being revcorded in the Office of the Clerk of the County Council of Berkeley County, West Virginia in Deed Book 263, at Pages 58-61 and being more particularly bounded and described as follows:
Lot No. 32 and the southern one-half of Lot No. 33: “Beginning at a point common corner to Lot No. 32 and Lot No. 31 and in a line of Manor Drive (as designated on said plat); thence with the westerly boundary line of said Drive and Lot No. 32 in a northerly direction 88 feet to a point, corner to Lot No. 32 and Lot No. 33 and continuing in the same direction with the westerly boundary line, of Manor Drive and Lot No. 33 in a northerly direction for a distance of 44 feet to a point (unmarked), in the line of Manor Drive and Lot No. 33, being the midpoint of said lot; thence in a westerly direction, parallel with the northern and southern lot lines of lot No. 33, 150 to a point (unmarked) in the common lot line of Lot No. 33 and Lot No. 28, midpoint in said line between the northwesterly corner and southwesterly corner of Lot No. 33; thence in a southerly direction with such common line of Lot No. 33 and Lot No. 28, 44 feet to a point, common corner of Lot No. 33 and Lot No. 32, and continuing with the common line of Lot No. 32 and Lot No. 29 for 88 feet to a point, common corner to Lot No. 32 and Lot. No. 31; thence proceeding in an easterly direction, along the southern boundary of Lot No. 32, 150 feet to the point of beginning, as set forth in said plat”.
Being the same property conveyed to Mary Anne Carter by the Deed dated May 23, 2017 and recorded in Deed Book 1178 at Page 472 in the Office of the Clerk of the County Commission of Berkeley County, West Virginia.

1) The property will be conveyed is an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, Liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West
Virginia ยง 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance whall be in the sole discretion of the Trustee.
5). The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
