The purpose of this notice is to satisfy two (2) separate but related procedural requirements for an CHDO Set-Aside activity to be undertaken by the Habitat for Humanity of the Eastern Panhandle.

REQUEST FOR RELEASE OF FUNDS

On or after July 7, 2021, the City of Martinsburg, which is the Participating Jurisdiction (PJ) of the Eastern Panhandle HOME Consortium, will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnership (HOME) funds under the National Affordable Housing Act of 1990, as amended (P.L. 101-625), to undertake a project funded by the FY 2018 HOME Program for the purpose of developing a new affordable residential dwelling unit in Shepherdstown, WV.

ASSESSED PROJECT

CHDO Set-Aside – Lot 20 Sage Place. HOME CHDO Set-Aside funds will be used to construct one (1) new affordable residential dwelling unit (one half of a duplex) on Lot 20, Sage Place, Shepherdstown, WV by Habitat for Humanity of the Eastern Panhandle. The project will include $73,498.00 in FY 2018 HOME Program funds. The total project cost is estimated to be $263,730.25 (HUD and non-HUD funds). The anticipated project start is Calendar Year 2021 and the anticipated project completion is Calendar Year 2022.
This activity is assessed under HUD regulations at 24 CFR Part 58.

FINDING OF NO
SIGNIFICANT IMPACT (FONSI)

The City of Martinsburg has determined that the above-identified project will have no significant impact on the human environment. Therefore, an Environment Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Martinsburg Community Development Department, 232 North Queen Street, Martinsburg, WV 25401. This project information is available for public examination and copying, upon request, during normal
office business hours
Monday through Friday from 8 a.m. to 5 p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Martinsburg, Community Development Department, via email at: nstrine@cityofmartinsburg.org,
or via mail at: 232 North Queen Street,
Martinsburg, WV 25401. All comments received by July 6, 2021 will be
considered by the City of Martinsburg prior to authorizing submittal of a request for release of funds.
Commenters should specify which of the two (2) Notices provided herein they are
addressing.

ENVIRONMENTAL
CERTIFICATION

The City of Martinsburg certifies to HUD that the Honorable Harriett E. Johnson, in her capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Martinsburg, which is the Participating Jurisdiction (PJ) of the Eastern Panhandle
HOME Consortium, to use HOME funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and City of Martinsburg’s certification received by July 22, 2021, or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Martinsburg; (b) the City of Martinsburg has omitted a step or failed to make a decision or finding required by HUD regulations found in 24 CFR Part 58; (c) the City of Martinsburg or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Section 58.76),
