Commercial Liability Partners WV, LLC (CLP WV) has submitted an application to the West Virginia Department of Environmental Protection (WVDEP) to participate in a voluntary environmental cleanup at the former Creo/Kodak property under the Voluntary Remediation and Redevelopment Act. The site is located at 1 Grace Street, Middleway, Jefferson County, West Virginia, and is comprised of approximately 259 acres of property.
Former uses of the property include woolen operations from 1946 until 1960. From 1960 to 2006, the property was used as a photographic equipment and lithographic plate processing facility. In 2006, the lithographic plating process was discontinued and Creo Manufacturing America, LLC, a wholly-owned subsidiary of Eastman Kodak Company (Kodak) entered the property into the West Virginia Voluntary Remediation Program (VRP). Site assessment activities to evaluate possible environmental impacts that may have been caused by the facility operations began at that time and were completed in 2014. In 2014, Kodak withdrew from the VRP. In 2015, CLP WV purchased the property and applied to the VRP. CLP WV intends to perform necessary remedial activities and re-develop the majority of the approximately 259-acre property for commercial or industrial use. The western portion of the property (approximately 60 acres consisting of fields, woods, and creeks) may be designated for recreational use, possibly by a historical society.
The Office of Environmental Remediation (OER) at the WVDEP is currently negotiating a Voluntary Remediation Agreement with the applicant to address environmental conditions associated with the historic operations at the site. The agreement includes provisions for identifying human health and ecological risks associated with current and potential uses of the site; establishing appropriate remediation standards; and performing additional remedial actions, if necessary, to meet those standards. Upon completion of remediation, the applicant will submit a final report to OER to confirm that the work performed meets all applicable remediation standards.

Current Site Use:
The site is currently unoccupied. A Site Assessment Report and Supplemental Site Assessment Report were previously submitted to WVDEP and accepted. A Risk Assessment Report was also previously submitted to WVDEP; comments on this report were issued by WVDEP and addressed by the previous owner via their consultant.
Suspected Contaminants:
Contaminants of potential concern include trichloroethylene, vinyl chloride, copper, lead, manganese, selenium, and zinc.
Cleanup Method:
Proposed remediation methods include establishing an institutional control such as a land us covenant that prohibits use of groundwater for drinking water, backfilling the spill ponds with a layer of clean soil, and potentially treating the TCE in groundwater at the source area. In addition, deed restrictions will be put in place that require proper safety precautions when trenching, and an evaluation of the potential for vapor intrusion if new structures are built in the TCE source area. Once the cleanup method(s) are finalized, a second public notice will be issued.
