PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON CASE NO. 25-0364-SWF-PC DISPOSAL SERVICE, INC., LCS SERVICES, INC., MEADOWFILL LANDFILL, INC., AND NORTHWESTERN LANDFILL, INC. Petition for consent and approval to Modify Escrow Agreements. NOTICE OF FILING & HEARING On April 7, 2025, Disposal Service, Inc., LCS Services, Inc., Meadowfill Landfill, Inc., and Northwestern Landfill, Inc. (collectively, Petitioners) filed an application to request the Commission approve (i) the termination of the current escrow agreements with JPMorgan Chase Bank, N.A. (JPMorgan) and WesBanco Bank, Inc. (WesBanco), (ii) the liquidation of the current escrow accounts at JPMorgan and WesBanco, and (iii) the use of surety bands to demonstrate financial assurance for closure and post-closure costs for the Landfills. The Petitioners have requested to terminate and liquidate the following escrow agreements: 1. Escrow agreement entered into on March 30, 2000 between Disposal Service Incorporated (DSI), the Commission, and Bank One West Virginia (now JPMorgan). 2. Escrow agreement entered into on November 21, 2001 between LCS Service Landfill (LCS), the Commission, and Bank One West Virginia (now JPMorgan). 3. Escrow agreement entered into on September 24, 1996 between Mid-American Waste Systems of Harrison, Inc. (now Meadowfill Landfill, Inc.), the Commission, and The Heritage Bank of Harrison County, Inc. (now WesBanco). 4. Escrow agreement entered into on December 10, 1998 between Northwestern Landfill, Inc. (Northwestern), the Commission, the Parkersburg Utility Board (PUB), and WesBanco. The Petitioners were notified by JPMorgan that it desired to cease serving as the escrow agent for the DSI and LCS escrow accounts. The Petitioners have submitted closure plans, including estimated closure and post-closure costs, for the Landfills to the West Virginia Department of Environmental Protection. The West Virginia Department of Environmental Protection has reviewed the closure plans and has agreed with the estimated closure and post-closure costs for the Landfills. Petitioners submit that any surety bonds obtained by Petitioners will be in an amount at least equal to the estimated closure and post-closure costs for the Landfills. The Commission set a hearing date on the Application which will begin at 9:30 a.m. on November 17, 2025, in the Howard M. Cunningham Hearing Room at the Commission's offices at 201 Brooks Street, Charleston, West Virginia. The Commission may cancel the hearing for good cause shown. Interested persons intending to attend the hearing should monitor the web docket. Anyone desiring to protest or intervene should file a written protest or request to intervene that briefly states the reason for the protest or request to intervene. Requests to intervene must comply with the rules on intervention set forth in the Commission's Rules of Practice and Procedure and must be filed by 4:00 P.M. on October 3, 2025.
