REQUEST FOR PROPOSALS FOR LEGAL SERVICES The City of Oak Hill, located in Fayette County, West Virginia, is seeking proposals from qualified attorneys or law firms to provide legal services related to real property transactions. The City intends to retain legal counsel to conduct title searches and prepare deeds for properties that are part of the City of Oak Hill Acquisition and Demolition Project, which is funded through the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP). It is anticipated that up to nine (9) properties may participate in the project; however, participation is voluntary and the final number of acquisitions may vary. The contract will be awarded on a per-property basis. The City of Oak Hill is undertaking the acquisition and demolition of residential properties located in the Minden area of Fayette County that have been identified as repetitive loss structures due to repeated flooding events. The purpose of this project is to permanently reduce flood risk and enhance community resilience by removing structures located in hazard-prone areas. Participation in the Hazard Mitigation Grant Program is completely voluntary for property owners. All acquisitions are conducted on a willing-seller basis, and no property owner is required to participate. The attorney or firm selected under this RFP will be responsible for performing all legal work necessary to complete the property acquisition process associated with the FEMA Hazard Mitigation Grant Program. Services will include conducting a complete title search sufficient to issue a title opinion for each property, identifying any liens, encumbrances, easements, restrictions, ownership issues, or other matters affecting title, preparing and reviewing all legal instruments necessary for conveyance including deeds, affidavits, and related documents, providing recommendations regarding any corrective actions necessary to address title-related issues identified during the title examination process, and coordinating with the City and any relevant parties to ensure proper execution, recording, and delivery of all documents. The attorney or firm will be expected to work closely with the City, Region 4 Planning and Development Council, property owners, and any other involved agencies to ensure compliance with FEMA and State of West Virginia requirements. Procurement of these services will be conducted in accordance with the requirements of 2 CFR Part 200 and all applicable federal, state, and local requirements. Proposals shall include the firm's qualifications and experience related to real estate transactions, title examinations, and property acquisitions, along with a proposed fee per completed title search and deed package. Proposals will be evaluated based on the experience and qualifications of the attorney or firm, demonstrated knowledge of West Virginia property law and municipal requirements, cost-effectiveness of the proposed services, and the responsiveness and completeness of the proposal. This contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project sponsor, price and other factors considered.
