Notice is hereby given, that the undersigned Substitute Trustee, by the virtue of the authority vested in it by that certain Deed of Trust dated February 27, 2015, recorded in the Office of the Clerk of the County Commission of MercerCounty, West Virginia, in Deed of Trust Book 1291, at Page 361, executed by Rodney M. Gilley, to Robert D. Lewis, State Director of the Rural Housing Service for the State of West Virginia, or its successor agency, and the successors in office as State Director or Acting State Director, as Trustee, for the benefit of the United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

January 28, 2020 at 11:47 a.m.

The following described property, with its improvements, easements and appurtenances thereunto belonging, situate in the Beaver Pond District, MercerCounty, West Virginia, and more particularly described as follows:
All that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, known as Lot 9R Hope Vista Subdivision, State Route 20, Beaver Pond District, Mercer County, West Virginia, as shown on a map entitled “Map Showing Revised Lot 9 Hope Vista Subdivision, State Route 20 Beaver Pond District, Mercer County, WV” by Appalachian Engineering & Surveying, Inc., Dated 6/7/10, rev. 7/24/10, 4/16/13″ to be recorded simultaneously herewith, and which property is more particularly bounded and described as follows:
BEGINNING at a point in the southeast right-of-way line of Vista Road, said point being northeast corner of Lot 8R and the northwest corner of Lot 9R and the herein described tract; thence along said right-of-way N. 50 deg. 25′ 52″ E. 69.66 ft. to a point; thence leaving said right-of-way and along the southwest line of Lot 10R for the next two calls: S. 39 deg. 10′ 56″ E. passing a capped rebar (set) on line at 10.42 ft. and continuing for a total distance of 38.66 ft. to a capped rebar (set); S. 36 deg. 09′ 30″ E. 106.07 ft. to a capped rebar (found); thence along the northern line of Lot 14 S. 60 deg. 50′ 20″ W. 61.57 ft. to a capped rebar (found); thence along the northeast line of Lot 8R N. 40 deg. 39′ 22″ W. passing a capped rebar (set) at 124.38 ft. and continuing for a total distance of 133.43 ft. to the point of BEGINNING and containing 9,168 sq. ft. or 0.211 acre more or less.
At the time of the execution of the Deed of Trust, the property was reported to have a mailing address of 274 High View Road, Bluefield, WV 24701.
AND BEING the same real estate conveyed to Rodney M. Gilley by Deed dated February 27, 2015 from Community Action of South Eastern West Virginia, Inc. and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 1015, at Page 637.
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
5) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale. Title will be conveyed by Trustee’s Deed upon payment of balance. There will be no refund granted of any amount if the third party purchaser elects not to purchase the property for any reason.
