NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated July 21, 2009, from Roger Rose and Lisa Rose to Thomas S. Lilly and Phillip B. Ball, Trustees, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 1172, at page 218, securing a promissory note in the principal amount of $189,500.10, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on December 2, 2019 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all of those certain lots or parcels of real estate, together with improvements thereon and appurtenances thereunto belonging, designated as Lot 18 and Lot 24 on a plat entitled ‘MAP SHOWING DIVISION OF PARCEL 35.3 AND PART PARCEL 35.7 TAX MAP 12 COUNTY ROUTE 71/8, VALLEY VIEW ESTATES BEAVER POND DIST., MERCER CO., WV JOB NO. 07080 DATE: 6-26-07 REVISIONS: 8/30/07 9/4/07 5/7/08 SCALE: 1″ = 100′ DRAWN BY: GKM’, said plat prepared by Appalachian Engineering & Surveying, Inc. and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 16250, and more fully bounded and described as follows:

There is excepted and reserved from this conveyance so much of the above described property as situate in the right of way of County Route 71/8 and the private right of way leading to State Route 20 as shown upon said plat.

Together with a non-exclusive right-of-way through Lot 23 for ingress and egress to Lot 18 as shown upon the aforementioned plat.

This conveyance is made subject to those restrictive covenants pertaining to all the lots in said subdivision recorded in Deed Book 924 at Page 196.

Being the same property conveyed from Willis E. Bishop, Jr. and Bobby Bishop to Roger Rose and Lisa Rose, husband and wife, by Deed dated July 31, 2009, of record in the aforesaid Clerk’s office in Deed Book No. 940, at page 407.

Terms of the sale: Ten percent non-refundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
