The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated December 17, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5029, at Page 8208, Velayhudan Sahadevan did convey unto Marc J. Slotnick, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Town District, Raleigh County, West Virginia, and more particularly described as follows:
All those certain lots or parcels of land, together with improvements thereon, appurtenances thereunto belonging and rights incidental thereto as well as the recited exceptions and out-conveyances, situated in Revised Skyland Addition, Town District of Raleigh County, West Virginia, and being more particularly bounded and described as follows:

PARCEL A:
The surface, together with any appurtenances thereon, of a parcel of surface land, situate in the Dry Hill Section of Town District of Raleigh County, West Virginia, being a part of Parcel No. 1 as shown on a Map entitled “Map of C.E. Davis Lots” said Map being on record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 359 at Page 268,” that part of Parcel No. 1 more particularly bounded and described as follows, to-wit:

Beginning at a set 3/4 inch iron pipe in the West line of Dry Hill Road (W.V. A strip ten feet wide BEGINNING at a stake in the western boundary line of Lot 20 of said addition; thence N. 17deg. 12′ W. 159.96 feet to a rebar, the northwestern corner of said Lot 20; thence continuing N. 17deg. 12′ W. 40 feet across the foot of Skyline Drive (as shown on said map) to an old axle, the southwest corner of said Lot 19; thence continuing N. 17deg. 12′ W. 118.28 feet to a stake; thence leaving said Lot 19 and through Tract No. 1 of said addition, continuing N. 17deg. 12′ W. 35.23 feet to a stake;; thence S. 72deg. 48′ W. 10 feet to a stake; thence through said Tract No. 1 and Tract No. 2 of said addition, S. 17deg. 12′ E. 350 feet, more or less, to a stake; thence S. 72deg. 13′ 12″ E. approximately 11 feet to the point of BEGINNING, containing .0807 of an acre, more or less.

PARCEL C:
That certain lot or parcel of land situate in Town Tax district, Raleigh County, West Virginia, and being part of Tract No. 1 of the Revised Skyland Addition, as shown and designated upon that certain map entitled “REVISED MAP SKYLAND ADDITION RALEIGH COUNTY WEST VIRGINIA DEVELOPED BY C.E. DAVIS SCALE 1″=40′ JUNE 14, 1947, DENNIS M. LEARY, JR., C.E. BECKLEY, WEST VIRGINIA,” which said map is of record in the aforesaid Clerk’s Office, in Map Book No. 8, at page 151, to which said map reference is here made and made a part hereof, and which said part of Tract No. 1 herein conveyed is more particularly bounded and described as follows, to wit:
BEGINNING at an iron pin at the center of the back line of Lot No. 15 of the Skyland Addition, Raleigh County, West Virginia, as shown on a map Revised June 14, 1947; thence S. 59deg. 30′ W. 192.60 feet to the northwest corner of Lot No. 19; thence N. 17deg. 12′ W. extending the line of Lot No. 19, 186.00 feet, more or less, to a fence line on Tract No. 1 of the aforesaid addition; thence N. 78deg. 00′ E. with the fence line 116.50 feet, more or less, to a corner post; continuing N. 78deg. 00′ E. 47.30 feet to an iron pin; thence S. 27deg. 58′ W. 131.49 feet to the iron pin in the center of the back line of Lot No. 15 and the point of BEGINNING and containing 0.64 acres, more or less.
There is expressly EXCEPTED and RESERVED by Elizabeth J. Starr in that certain Deed dated December 20, 1997, and recorded in the aforesaid Clerk’s Office in Deed Book 126, at Page 657, that part of said 0.64 acre tract as is more particularly bounded and described as follows, to wit:
BEGINNING at the northeast corner of Lot No. 17 of Skyland Addition, a common corner with Lot No 15 of said addition; thence with the northern boundary line of said Lot No. 17 and Lot No. 19 of said addition S. 59deg. 30′ W. 154.12 feet to an old iron pin, the northwest corner of said Lot No. 19; thence leaving Lot No. 19, N.17deg. 12′ W. 35.23 feet to a stake; thence through said 0.64 acre tract N. 72deg. 48′ E. 150 feet to the point of BEGINNING and containing .0606 of an acre, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 155 Dry Hill Road, Beckley, WV 25801.

AND BEING the same real estate which was conveyed to Velayhudan Sahadevan by Deed dated December 17, 2007, from Victoria C. Sahadevan, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5029, at Page 8206.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
