PUBLIC NOTICE OF PROPOSED ORDINANCE TO
AMEND THE CODE OF THE
TOWN OF MONONGAH, WEST VIRGINIA
WITH REGARD TO SEWER SERVICE RATES
Notice is hereby given that the Town of Monongah, a municipal corporation, will hold a hearing before the final vote on a proposed ordinance, the principal object of which is the increase of sewer rates for customers of the sewer system operated by the Town of Monongah. The title of such ordinance is “An Ordinance to Amend the Code of the Town of Monongah, West Virginia with Regard to Sewer Service Rates.” The final vote on adoption of said proposed ordinance shall be held in the Town Hall of the Town of Monongah, 430 Bridge Street, Monongah, West Virginia, on May 13, 2019, at six thirty (6:30) p.m. Copies of the proposed ordinance are available at the Town Hall. Interested parties may appear and be heard at such time with respect to the passage of the following ordinance:
BE IT ORDAINED by the Town Council of the Town of Monongah that Sewer Service Rates be AMENDED as follows:
SEWER SERVICE RATES
For the payment of the proper and reasonable expense of operation, repair, replacements, improvements, additions, betterments, extension, and maintenance of the Sewer system and for the payment of the sums required to pay the principal and interest on all Sewer revenue bonds as the same become due, there is hereby established a schedule of just and equitable rates, charges and penalties for the use of and services rendered by the municipal Sewer system and works of the Town of Monongah, West Virginia, which schedule, based upon the metered amount of Sewer supplied to the premises shall be as follows:
RATES, RULES AND REGULATIONS
FOR FURNISHING SEWER SERVICE
At the Town of Monongah, Marion. County, West Virginia
SCHEDULE I. A.
APPLICABILITY
Applicable within the entire territory served, to all bills rendered on and after July
1, 2019, and continuing until July 1, 2020.
AVAILABILITY
Available for general, domestic, commercial and industrial service.
RATES (customers with metered Sewer supply)
First 2,500 gallons used per month
$13.31 per 1,000 gallons
Next 12,500 gallons used per month
$12 76 per 1,000 gallons
Next 35,000 gallons used per month
$ 9.87 per 1,000 gallons
All Over 50,000 gallons used per month
$ 8.18 per 1,000 gallons
MINIMUM CHARGE
No monthly bill will be rendered for less than $26.62.

APPLICABILITY
Applicable in entire territory served to all bills rendered after July 1, 2020 and
continuing until the Inflow and Infiltration Correction Project is certified as
substantially complete.
AVAILABILITY
Available for general domestic, commercial and industrial service.
RATES (for all customers with metered water supply)
First 2,500 gallons used per month
$14.95 per 1,000 gallons

No monthly bill will be rendered for less than $29.90 (based on 2,000 gallon minimum usage).

Applicable in entire territory served on all bills rendered after the Inflow and Infiltration Correction Project is certified as substantially complete.
AVAILABILITY
Available for general domestic, commercial and industrial service.
RATES (for all customers with metered water supply)

$16.59 per 1,000 gallons

MINIMUM CHARGE
No monthly bill will be rendered for less than $33.18 (based on 2,000 gallon minimum usage).
SCHEDULE II
APPLICABILITY
Applicable within the entire territory served during all time periods.
RETURNED CHECK CHARGE
A service charge equal to the actual bank fee assessed to the Town of Monongah up to a maximum of $25.00 will be imposed upon any customer whose check for payments of charges is returned by their bank due to insufficient funds.
RECONNECTION FEE
$25.00 – To be charged whenever the supply of Sewer is turned off for violations of rules, nonpayment of bills, or fraudulent use of Sewer.
SECURITY DEPOSIT
Not to exceed two/twelfths (2/12) of the average annual usage of the applicant’s specific customer class, or fifty dollars ($50.00), whichever is greater. This fee may be changed by applicable statutory provisions.
DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full when due, ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to only be collected once for each bill where it is appropriate.
TAP FEE
The following charges are to be made whenever the utility installs a new tap to serve an applicant. A top fee of $300.00 will be charged to all customers who apply for service.
LEAK ADJUSTMENT
$2.98 per 1,000 gallons is to be used when a bill reflects unusual consumption which can be attributed to eligible leakage on the customer’s side of the meter.
This rate shall be applied to all such unusual consumption above the customer’s historical usage.
SURFACE OR GROUND WATER SURCHARGE
An additional amount shall be charged where surface or ground water is introduced into the sanitary system where evidence of a violation exists.
Surcharge formula to be applied in cases where surface drainage is connected to the utilities sewer system.
Said surcharge shall be calculated and imposed for each month that said condition continues to exist. Failure to pay the surcharge and/or correct the situation shall give rise to the possible termination of water service in accordance with the rules and Regulations of the Public Service Commission of West Virginia.
The Town shall not impose the surcharge unless, and until, the customer has been notified by certified mail, return receipt requested, or by hand delivery, that it has been established by smoke testing, dye testing, or on-site inspection that rain or other surface water is being introduced into the sanitary sewer system at the customer’s location, and that the customer has not acted within thirty (30) days from receipt of such notice to divert the water from the sanitary sewer system.
APPLICABILITY
Where the utility has discovered that a customer’s roof drain, downspout, storm sewer, or other similar facilities conducting surface water have been connected to the utility’s sewer system, and such customer has failed to take appropriate action within thirty (30) days of receipt of a demand by the Utility, in accordance with the Rules and Regulations of the Public Service Commission, to eliminate such connection, a surcharge will be imposed upon the customer calculated on the basis of the following formula:
S = A x R x .0006233 x C
S – The surcharge in dollars
A – The area under roof and/or the area of any other water collection surface connected to the sanitary sewer, in square feet
R – The measured monthly rainfall, in inches
.0006233 – A conversion factor to change inches of rain x square feet of surface to
thousands of gallons of water
C – the utility’s approved rate per thousand gallons of metered water usage.
