NOTICE OF SPECIAL ELECTION
At a regular meeting of the Board of Education of the County of Clay, State of West Virginia, held on the 14th day of November 2016 as provided by law, the following order was made and entered of record. TO_WIT:
The Board of Education of the County of Clay being fully aware that the maximum levies for current expenses authorized by Article 8, Chapter 11, of the Code of West Virginia, 1931, as amended, will not provide sufficient funds for the payment of general current expenses of schools in Clay County, including expenditures for the purposes hereinafter stated, during the fiscal years beginning July 1, 2017, July 1, 2018, July 1, 2019, July 1, 2020 and July 1, 2021, and having ascertained that the amounts hereinafter shown in excess of the amounts raised by regular levies will be needed by the Board of Education of the County of Clay during each of said five (5) fiscal years, and that the question of increase of such levies should be submitted to the voters of Clay County at a special election to be held January 28, 2017, in conformity with law, it is hereby ordered and declared:
(1) The purpose for which additional funds are needed is the payment of the general current expenses of the Board of Education of the County of Clay, including the repair, maintenance, and operation of school buildings and equipment; the purchase of textbooks, library books, and instructional supplies and equipment; to help pay for utilities for all schools which include gas, water, electricity, garbage collection and exterminating for all schools; to provide for the transportation, including activity buses, of pupils; to support extra-curricular activities including athletics, music, drama, 4-H, field trips, student clubs; and for the continued operation of H.E. White and Lizemore Elementary Schools.
(2) The approximate annual amount considered necessary for each purpose is as follows:
a.     Building Maintenance –    $     113,651.16
including the repair and maintenance of
roofs on each school, remodeling and
construction, fix and maintain heating and
cooling systems, and repair of equipment
b.     Textbooks, School Supplies, & Equipment –    $    140,710.96
including library books, workbooks,
pencils, paper, and other materials and
equipment needed within the classroom,
and additional air conditioning as needed
in all schools Pre-K -12
c.    Utilities –    $    129,887.04
including gas, water, electricity,
garbage collection and exterminating
for all schools
d.    Transportation –    $     81,179.40
including activity buses, field trips,
transporting students to job sites,
ballgames and other Pre-K-12 school
sponsored activities
e.    Extra Curricular Activities –    $    43,295.68
including athletics, music, 4-H, drama,
student clubs, the arts, and pre-K-12
after school programs
f.     Instructional Equipment –    $    32,471.76
including the repair and maintenance of
computers, projectors, classroom monitors,
and other equipment located within
classrooms at all schools annually.
TOTAL    $    541,196.00
(3) The total amount necessary to carry out the above purposes is $541,196.00 annually.
(4) The separate and aggregate assessed valuation of each class of taxable property within the Clay County School District for the assessment year of 2016 is as follows:
Class I        $    0.00
Class II            77,995,690.00
Class III            157,113,871.00
Class IV            12,242,748.00
Total           246,948,933.00
(5) The proposed additional vote of levy in cents on each class of property within Clay County School District for the fiscal years beginning July 1, 2012, July 1, 2013, July 1, 2014, July 1, 2015, and July 1, 2016 is as follows:
Class I Property     Zero dollars and 6.50 cents
Class II Property     Zero dollars and 13.00 cents
Class III Property     Zero dollars and 26.00 cents
Class IV Property     Zero dollars and 26.00 cents
Provided, however, that the Board of Education of the County of Clay may, as a levying body, reduce the rate of excess levy if any appraisal or general evaluation of property in Clay County, West Virginia, would produce an assessment that would cause an increase of 4{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} or more in the projected property tax revenues that would be realized were the special levy rates herein above set out then in effect.
(6) The years to which the additional levy shall apply, if authorized by the voters, are the fiscal years beginning July 1, 2017, July 1, 2018, July 1, 2019, July 1, 2020, and July 1, 2021.
(7) The question of such additional levies shall be submitted to a vote in the Clay County School District, which embraces Clay County, West Virginia, at the special election to be held in said county on Saturday, January 28, 2017.
(8) The Clay County Board of Education will not issue bonds to be paid for by the proposed levy.
(9) Notice of said election to authorize the additional levies shall be given by publication of notices thereof at least once a week for two successive weeks within fourteen (14) consecutive days next preceding the election in the Clay County Free Press, a newspaper of general circulation in the Clay County School District, for the same period.
(10) The official ballot to be used in the election herein shall be in the form as follows:

Special Election to authorize additional levies in the total amount of $541,196.00 annually for the fiscal years July 1, 2017, July 1, 2018, July 1, 2019, July 1, 2020, and July 1, 2021 for the purpose of:
The payment of general current expenses of the Board of Education of the County of Clay, including the repair, maintenance, and operation of school buildings and equipment; the purchase of textbooks, library books, and instructional supplies and equipment; to help pay for utilities for all schools which include gas, water, electricity, garbage collection and exterminating for all schools; to provide for the transportation, including activity buses, of pupils; to support extra-curricular activities including athletics, music, drama, 4-H, field trips, student clubs; and for the continued operation of H.E. The additional levies shall be on:
Class I Property    Zero dollars and 6.50 cents
Class II Property    Zero dollars and 13.00 cents
Class III Property    Zero dollars and 26.00 cents
Class IV Property    Zero dollars and 26.00 cents
