ZMA2024-03: Mark Roper is seeking to rezone approximately .81 acres of land from Old Town Residential to Planned Unit Development in order to build one single family detached home and nine townhome unit. The properties being rezoned are located between W. Academy Street and Ann Street, and are identified as Tax District 3/Map 4/Parcels 101, 102, 103, 105, 106. The 2040 Comprehensive Plan Future Land Use Map calls for these properties to be Old Town Residential.

ZMA2024-04: Request by Elm Street Communities Inc., to rezone approximately 180 acres of land from Urban Reserve to Neighborhood Residential. The properties are identified as 632 Vinton Lane (Tax District 3, Map 12, Parcel 218) and the larger surrounding tract of Tax District 3, Map 12, Parcel 217. Both properties front Vinton Lane and Berryville Pike. The 2040 Comprehensive Plan Future Land Use Map identifies these properties as Mixed-Use Residential and General Commercial.

The abovequoted title of the Ordinance describes generally the contents thereof and the purposes of the Bonds contemplated thereby.  The City contemplates the issuance of the Bonds described in the Ordinance.  The proceeds of the Bonds will be used to (i) pay a portion of the costs of design, acquisition, construction and equipping of certain extensions, additions, betterments, and improvements to the sewerage portion of the existing combined waterworks and sewerage system of the Issuer as described in the Ordinance (the “Project”); and (ii) pay costs of issuance for the Bonds and related costs.  The Bonds are payable from the revenues derived from the System and from the proceeds of combined waterworks and sewerage system revenue bonds issued by the City for the purpose of permanently financing the Project.  No taxes may at any time be levied by the City for the payment of the Bonds or the interest thereon.

The above-entitled Ordinance was adopted by the Council of the City of Charles Town on November 4, 2024.  A certified copy of the aboveentitled Ordinance is on file with the City for review by interested parties during regular office hours.

Following the public hearing, the City intends to enact the Ordinance upon final reading.

The County Commission of Jefferson County will hold a Public Hearing regarding a Zoning Map Amendment (rezoning) for the Media Farm properties designated as Tax District: Charles Town (02), Map: 4, Parcels: 11, 11.1, & 13. The properties are located on Media Farm Lane, west of Flowing Springs Road, south of the intersection with Daniels Road. The property owner of these three lots is Harvest Homes, LLC. The combined Parcel Size is approximately 127 acres. The properties are currently zoned Rural (R) and a petition has been made to the County Commission by the property owner to change the zoning classification from Rural to Residential Growth (RG) (Planning Commission File #24-2-Z).

The County Commission of Jefferson County has scheduled a Public Hearing to be held on Wednesday, December 4, 2024 at 6:00 PM to receive public input on the Planning Commission’s recommended DRAFT 2045 Comprehensive Plan. The hearing will be held in the Jefferson High School Auditorium, 4141 Flowing Springs Road, Shenandoah Junction, WV. This meeting will also be available live through ZOOM. 

You may provide oral or written comments at the hearing in Jefferson High School Auditorium. In addition, you may provide written comments to [email protected] or by mail to 116 East Washington Street, Charles Town, WV 25414 prior to the Public Hearing and through Wednesday, December 11, 2024 at 5:00 PM.

Staff will be available outside the Jefferson High School Auditorium on December 4, 2024 from 5:00 PM to 6:00 PM for an Open House with displays of relevant Land Use Maps and copies of the text to review. Questions and discussion may occur during the Open House. Please be advised, the County Commission only accepts comments during the Public Hearing; the Public Hearing is not an opportunity for questions and answers.
