In execution of a Deed of Trust dated September 14, 2009, and recorded in the Office of the Clerk of the Circuit Court of Buchanan County, Virginia as Instrument Number 090002723; and with the undersigned being appointed Substitute Trustee by document of record Instrument Number 190001079, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust and having parcel identification numbers of 2HH183334 INST A and 2HH183336 INST A and briefly described as follows:

All that certain lot or parcel of land, situate on and near Levisa River, about three miles above the Court House for Buchanan County, Virginia, and being known and designated as Lot No. Twenty-Seven (27), as shown on a plat designated “Alice Waldron Subdivision of Land Into Lots,” which plat is recorded in the Office of the Clerk of the Circuit Court of Buchanan County, Virginia in Plat Book No. 2, page 10.

All that certain lot or parcel of land situate in Buchanan County, Virginia, on the Levisa River, and lying between State Highway Route 460 and the Levisa River, known and listed as Lot Number 28 as shown on the Map or Plat of the division of the Alice Waldron land, recorded in the Office of the Circuit Court of Buchanan County, Virginia, in Plat Book 1, at Page 195.

AND BEING the same property conveyed unto the grantor herein by deeds, a copy of which deed is of record in the Clerk’s Office of the Circuit Court of Buchanan County, Virginia, in Deed Book 207 at Page 175 and Deed Book 259 at Page 799.
Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk’s Office which may affect the title to the real property hereinabove mentioned.

Place of Sale: Front Steps of the Buchanan County Courthouse, Temporary Physical Address: 4447 Slate Creek Road, Grundy, Virginia.
Terms of Sale: The Successful Bidder shall make a ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier’s check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder. The purchaser of the Property will be required to pay all closing costs except the Grantor’s Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser’s sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.
