NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated September 8, 2010, from Thomas R. Donchatz to Gary R. Mills and Stephen M. Feola, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1196, at page 304, as supplemented by the Order of record in said Clerk’s Office in Trust Deed Book 1367, at page 759, the undersigned trustee will offer for sale at public auction on May 1, 2019, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, the following:

Parcel No. 1:

All that certain lot or parcel of real estate situate in the City of Bluefield, Mercer County, West Virginia, and designated as Part Lot 30, Section 1624 as shown on ‘Map showing Lots 28-32, Section 164 to be divided from the F. K. Blizzard Parcel, Kirk St., Bluefield, Mercer Co., W. Va.’, made by Appalachian Engineering and Surveying, Inc. 4/15/83, which map has been filed fro record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat Record No. 8897 and which said property is more particularly bounded and described as follows:

Part Lot 30, Section 1624: BEGINNING at a point in the south line of Beacon Street situate at the northwest corner of Lot 29, Section 1624; thence S. 34 49′ E. with the west line of said Lot 29 134.82 feet to a point; thence S. 55 11′ W. 90 feet to a point; thence N. 34 49′ W. 134.82 feet to a point in said south line of Beacon Street, thence with said line N. 55 11′ E. 90 feet to the point of BEGINNING.

Parcel No. 2:

All that certain lot parcel of real estate situate in the City of Bluefield, Mercer County, West Virginia, and designated as Tract “B”, being part Lots 31 and 18A, as shown on a Plat entitled, ‘MAP SHOWING DIVISION LOTS 18, 19, 18A & 31, SECTION 1624, BRIERWOOD COURT, BLUEFIELD, MERCER CO., W. VA., DATE: 5-31-89, SCALE 1″ = 30′ “, made by Appalachian Engineering & Surveying, Inc., which map is of record in said Clerk’s Office as Microfilm Plat No. 10298, and which said tract is more particularly bounded and described as follows:

Tract “B” (Part Lots 18A and 31): BEGINNING at a point in the southern right-of-way line fo Beacon Street, said point also being the northwest corner of Lot 30 and the northwest corner of the herein described tract; thence leaving said right-of-way and with the west line of Lot 30, S. 34 degrees 49 minutes E 132.41 feet to a point; thence leaving Lot 30 S 55 degrees 11 minutes W 65.00 feet to a point; thence N 34 degrees 49 minutes W 132.41 feet to a point in the southern right-of-way line of Beacon Street; thence with said right-of-way N 55 degrees 11 minutes E 65.00 feet to the point of BEGINNING and containing 8,606.6 square feet plus or minus.

This conveyance is subject to restrictions, limitations and easements of record affecting the property hereinabove described.

The deed of trust states that the address of this real estate is commonly known as 4210 Beacon Street, Bluefield, West Virginia.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated September 22, 2014, of record in said Clerk’s Office in Trust Deed Book 1283, at page 696.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
