NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated September 23, 2016, executed by Nathan A. Thompson and Crystal L. Chavez to Phillip B. Ball, Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1324, at page 50, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee of record in the aforesaid Clerk’s office dated March 27, 2019, in Trust Deed Book 1370, at page 459, default having occurred in payment of the indebtedness secured by said deed of trust, and the undersigned substitute trustee having been requested to do so by Summit Community Bank, Inc., successor in interest to First Century Bank, Inc., owner and holder of the indebtedness secured by said deed of trust, the undersigned substitute trustee will offer for sale and sell at public auction on May 30, 2019, at 10:00 a.m., at the north entrance to the Mercer County Courthouse, 1501 Main Street, Princeton, Mercer County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:
“all of those certain tracts or parcels of real estate designated as Parcel ‘B’ and a 100-foot strip off of the eastern portion of Parcel ‘A’, as shown on a map ‘Showing Two Parcels of Land to be Conveyed Parcel ‘A’ to: John Seal and Lillie Seal; Parcel ‘B’ to: Ricky A. Childs and Barbara Childs; By: Roger Lee and Bernice Sue Hammonds Situated in Rock District Mercer County, W. Va. Scale 1” = 100′ Drawn 10-14-75 R. W. McComas, P. E. Reg. No. 2229 REF – Deed Book 486 – Page 586,’ said plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 5905, and more particularly bounded and described as follows:

PARCEL ONE: BEGINNING at a maple on the North bank of Black Lick Creek, thence running with creek, S. 59 00′ W. County Road, thence running with the County Road, N. 54 45′ W. 45.00 feet, S. 66 45′ W. 327.60 feet to an iron pin on edge of County Road, thence N. 13 42′ W. 850.00 feet (and between two houses) to a point on the ridge, thence running with said ridge N. 63 47′ E. 566.00 feet to a stone on ridge, thence following old fence line S. 13 42′ E. 9.3.50 feet to the point of BEGINNING, and containing 11.50 acres (11 1/2 ac) more or less.

PARCEL TWO: BEGINNING at the southern terminus of the boundary lines between Parcel ‘A’ and Parcel ‘B’ at an iron pin located on the northern line of the County Road as shown on said Map; thence with the County Road South 66 45′ W. 20.0 feet to a point; thence South 89 15′ W. 80.0 feet to a point; thence through Parcel ‘A’ in a northerly direction 840.0 feet to a point; thence through Parcel ‘A’ in a northerly direction 840.0 feet to a point on the northern line of Parcel ‘A’; thence with the northern line of Parcel ‘A’ North 63 47′ E. 100.0 feet to a point being the northern terminus of the division line between Parcels ‘A’ and ‘B’; thence with said division line South 13 42′ E. 850.00 feet to the point of the BEGINNING.

AND BEING the same property conveyed unto Nathan A. Thompson and Crystal L. Chavez by deed of Irma Howington dated September 9, 2016, said deed in Deed Book 1041 at page 438 recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

“This deed is subject to the rights of the owners of Parcel ‘A’, if any, to utilize a well and water on Parcel ‘B’ conveyed herein, as set forth in deeds of record.
“There is further granted an easement for the use of the septic system servicing Parcel ‘B’ located on Parcel ‘A’ as shown in prior deeds, with the affirmative obligation of maintaining the septic system in a sanitary condition.

“This conveyance is made expressly subject to all pertinent restrictions, reservations and easements of record.”

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
