FORECLOSURE SALE
OF VALUABLE RESIDENTIAL REAL ESTATE

Property Description: Lots 50-51 & Pt Lot 49 Block 38 Harrison, City of Princeton, Mercer County, West Virginia.

Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in us under that certain Deed of Trust dated the 13th day of March, 2009, executed by Tonimarie Morris unto Mike Day and Harold B. Wolfe, III, as Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1161, at Page 512, which said Deed of Trust secured MCNB Bank and Trust Co. , and pursuant to a Substitute of Trustees dated February 11th, 2019, and recorded February 21, 2019, in Trust Deed Book 1368, at Page 477, whereby the undersigned were substituted as trustees in place and stead of the said Mike Day and Harold B. Wolfe, III, we will
ON THE 23rd DAY OF April, 2019, AT 10:15 O’CLOCK A.M., at the front door of the Mercer County Court House (being the North Walker Street side) at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit:
all those certain tracts or parcels of real estate,
together with the improvements thereon, situate in the City of Princeton, Mercer County, West Virginia, and known as Lots Nos. 50 and 51 and ten feet off of the east side of Lot No. 49, of Block No. 7, Section No. 2″, and which property is more particularly bounded and described as follows:
“Said Lots 50 and 51 front 30 feet each on Harrison Street, and the ten feet off the east side of Lot No. 49 fronts ten feet on Harrison Street to Alley “F” as shown on a map of the Prince Addition to the City of Princeton, made by Clark & Krebs, and of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, as Microfilm Plat No. 888.”
And being the same property conveyed unto Tonimarie Morris by deed of Roberto Rivera, Jr., dated March 13, 2009, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 935, at Page 400.
“There is excepted and reserved from the operation of this deed the right of Henry Clark to use the ten feet strip off Lot No. 49, along with the grantees herein, their tenants, agents and employees, which right is set forth in a deed from J. E. Marcum and wife to the said Henry Clark, dated the 21st day of May, 1923, and recorded in the said Office in Deed Book 152, at Page 523.”
The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note) and said property is being sold in ”as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.
In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
