NOTICE OF
TRUSTEE’S SALE
Take notice that on the 16th day of April, 2015, at 10:00 a.m., at the front entrance of the Marion County Courthouse, Fairmont, West Virginia, the undersigned Substitute Trustee will sell at public auction to the highest bidder the real estate hereinafter described pursuant to that certain deed of trust dated April 20, 2006. executed by Earl Lee McCabe III and Linda Mae McCabe to Mary B. Sansalone, Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book No. 860, at page 303, default having been made therein, that certain lot or parcel of real estate situate in the M. N. Barnes Addition to the City of Fairmont, Fairmont District, Marion County, West Virginia, a map or plat of which is of record in said Clerk’s office in Deed Book No. 113, at page 121, being all of Lot B, fronting 40 feet on Maple Avenue, beginning at a stake in line of Maple Avenue, and a corner to lot owned by James Jack and running thence with Maple Avenue, S. 85° E. 40 feet to a stake in the corner of Lot C; thence with line of Lot C, S. 6° 7′ E. 127 feet and six inches to a stake in line of alley dedicated to the use of the public, being 16 feet wide; thence with line of said alley 37 feet to a stake, corner to lot of James Jack and thence with the same N. 6° 50′ W. 137 feet to the place of beginning.
Said real estate was more recently surveyed, and is shown on a map or plat of record in said Clerk’s office in Deed Book No. 1012, at page 230, and described as follows:
Beginning at a one inch iron pipe (found) in the easterly line of a 30 foot street; thence N. 65° 25′ 31″ W. 31.31 feet to a 5/8″ iron bar with cap (set), said 5/8″ iron bar being the northeasterly corner of Lot D, now or formerly owned by Fairmont Community Development Partnership (Deed Book No. 997, at page 343); thence N. 76° 55′ 00″ W. 78.53 feet to a 5/8″ iron bar with cap (set), said 5/8″ iron bar being a common corner of Lot B and Lot C, now or formerly owned by said Fairmont Community Development Partnership, and being the true point of beginning; thence with a common line of said Lots B and C, S. 04° 54′ 53″ W. 130.96 feet to a 5/8“ iron bar with cap (set) in the northerly line of a 16 foot alley, said iron bar being another common corner of said Lots B and C; and thence with the northerly line said alley for two lines, S. 88° 49’ 58“ W. 26.10 feet to a 5/8″ iron bar with cap (set); thence S. 77° 34′ 27″ W. 10.09 feet to a 5/8″ iron bar with cap (set), said point being a common corner of said Lot B and Lot A now or formerly owned by Felix Harris and Louisa Harris (Deed Book No. 622, page 282); thence with a common line of said Fairmont Community Development Partnership and said Harris, N. 03° 33′ 34″ E. 142.34 feet to a 5/8″ iron bar with cap (set) in the southerly line of Maple Avenue, said point being another common corner of said Lots A and B; and thence with the southerly line of said Maple Avenue, S. 76° 55′ 00″ E. 39.36 feet to the point of beginning, containing 5,054 square feet, or 0.12 acres, more or less.
The above real estate was conveyed to Earl Lee McCabe III or Linda Mae McCabe by Fairmont Community Development Partnership, Inc., by deed dated April 10, 2006, of record in said Clerk’s office in Deed Book No. 1012, at page 228.
Conveyance of said real estate is subject to the exceptions, reservations, restrictions, rights of way, and conditions, of record, affecting said real estate, and is subject to all unpaid property taxes assessed against said real estate.
The above described real estate has address of
506 MAPLE AVENUE, FAIRMONT,
WEST VIRGINIA 26554.
The property will be conveyed in an “as is” physical condition, without warranty as to habitability or fitness.
The trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the trustee.
By written substitution of trustee dated February 12, 2015, of record in said Clerk’s Office in Book No. 1110, at page 771, J. Scott Tharp was substituted as substitute trustee under the provisions of said deed of trust.
Hie total purchase price is payable to the trustee by cashier’s check, cash, or the equivalent within 20 days of the date of sale, with 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the total purchase price payable to the trustee at sale by cashier’s check, cash, or the equivalent.
