TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed Of Trust, dated June 10, 2002, and duly recorded in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Document No. 9952, in Book No. 104, at Page 204, Lewis Sherman Mullins and Catherine J Mullins did convey unto James B Crawford III, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Federal Home Loan Mortgage Corporation, as Trustee for the benefit of the Freddie Mac Seasoned Loans Structured Transaction Trust, Series 2021-1 to foreclose thereunder, will offer for sale at public auction at the front door of the Clay County Courthouse in Clay, West Virginia, on

All that certain tract of land, together with the improvements thereon and appurtenances thereunto belonging, lying and being situate in Henry District, Clay County, West Virginia, more particularly bounded and described as follows:
BEGINNING at a stone at the northern edge of State Route 36, corner to Paul Hopkins tract, thence S.
26-42W., 214.09’ to a point, thence S. 23-59 W., 97.41’ to a point, thence S. 18-45 W. , 50.20’ to a point,
thence leaving said right of way and crossing parent tract; N. 43-21 W., passing a 1/2” iron rod set at
28.32’ to a total distance of 214.42’ to a 1/2” iron rod set; thence N. 39-25 E., 54.33’ to a 1/2” iron rod
set; thence N 48-12 E., 86.42’ to a 16” poplar; thence S. 55-54 E., 23/77’ to a 1/2” iron rod set; thence
N. 31-32 E., 123.49’ to a fence post; thence N. 39-32 E., passing a 1/2” iron rod set at 38.74’ a total
distance of 47.86’ to a point in Hopkins line, said point being S. 56-31-10 E. 11.49 from a 12” White
Walnut; thence S. 56-311-10 E. , passing an iron rod found at 83.76 acres, a total distance of 102.48’ to
the place of beginning, containing 1.11 acres, more or less, and more fully described on a plat prepared
by Wallace J. Board Land Surveying, dated the 24th day of October, 1994, and titled “Map prepared for
Roy G. Mullins, Job No. 94-486”.

The Grantors further reserve a twenty foot right of way over, through and across the property hereby conveyed, said right of way set out and shown on that certain map referenced hereinabove and said right of way shall be for the benefit of the Grantors, their heirs, assigns, successors in title and legal representatives and be ingress and egress to the residue property owned by the Grantors of which this conveyance is a part, and said right of way shall run with the land and binding on the Grantees, their heirs, assigns, successors in title and legal representatives.
The Grantors further reserve a twenty foot right of way over, through and across the property hereby conveyed, said right of way being located from the right of way reserved hereinabove unto the residential home site now situate on the residue of said property, and said right of way shall be for the benefit of the Grantors, their heirs, assigns, successors in title and legal representatives and be ingress and egress to said residential home site on the residue property owned by the Grantors of which this conveyance is a part, and said right of way shall run with the land and binding on the Grantees, their heirs, assigns, successors in title and legal representatives. This conveyance is made subject to the same reservations and exceptions set out and referred to in deeds in the chain of title hereto.
This conveyance is made subject to any out conveyance, easements, rights of way, and any other reservation and exceptions of record in said clerk’s Office in chain of title of the property hereby conveyed and is further subject to any state of facts which a reasonable inspection of the premise might reveal.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2853 Wallback Rd, Wallback, WV 25285.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
