NOTICE OF TRUSTEE SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated June 21, 2021, executed by GREENBRIER PREMIER RENTALS & PROPERTY, LLC, A WEST VIRGINIA LIMITED LIABILITY COMPANY, unto BARRY L. BRUCE, SUCCESSOR TRUSTEE, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 859 at page 258, the Maker of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the Holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, will offer for sale at public auction to the highest bidder on Thursday, September 8, 2022, at 10:00 a.m., of that day, at the front door of the Courthouse of Greenbrier County, Lewisburg, West Virginia, the following described real estate, to wit:
TRACT ONE:
All of that certain real estate, together with the buildings and improvements located thereon, and the rights-of-way, easements and appurtenances thereunto belonging, situate, lying and being in Lewisburg Corporate District, County of Greenbrier, State of West Virginia, and being more particularly bounded and described as follows:
All of those four certain lots or parcels of real estate, together with the buildings and improvements
thereto and the easements and appurtenances thereunto belonging, situate in Patton Heights Subdivi-
sion, Lewisburg Municipality, formerly Lewisburg District, Greenbrier County, West Virginia, and
more particularly delineated upon a map or plat of said Subdivision of record in the Office of the
Clerk of the County Commission of Greenbrier County, West Virginia, in Map Book 2, at Page 163,
as follows, to wit: Lots No. 96, 98, 100 and 102.
AND BEING a part of that same real estate conveyed unto Greenbrier Premier Rentals & Property, LLC, a West Virginia Limited Liability Company, from Mark Grim, by deed dated April 27, 2021 , and of record in the Office ofthe Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 626 at page 509.
TRACT TWO:
All of that certain real estate, together with the buildings and improvements located thereon, and the rights-of-way, easements and appurtenances thereunto belonging, situate, lying and being in Ronceverte Corporate Distract, County of Greenbrier, State of West Virginia, and being more particularly bounded and described as follows:
Beginning at a 1/2” rebar set in the eastern R/W of U.S. Rte. 219; thence with said R/W N 7-09-30
W 20.00 feet to a 1/2” re-bar set; thence continuing with said R/W N 82-50-30 E 5.00 feet to a 1/2”
re-bar set; thence N 7-09-30 W 73.88 feet to a 1/2” re-bar set, a corner to Ida Laura Smothers; thence
leaving Rte. 219 and with said Smothers N 82-50-30 E 95.99’ to a 1/2” iron pipe found; thence
continuing with Smothers N 823-50 W 75.00 feet to a 1/2” iron pipe found in the southern bound-
ary line of Leroy L. Erskine; thence leaving Smothers and with said Erskine N 79-23-14 E 43.26
feet to a 1/2’ iron pipe found in the southwestern R/W of Lewisburg Avenue, a corner to Samuel E.
Daniels; thence leaving Erskine and Lewisburg Avenue and with Daniels S 8-08-00 E 149.05 feet
to a 1/2” re-bar set; thence leaving Daniels and through the property of Stephen G. Morgan S 74-02-
57 W 146.81 feet to the place of beginning and containing 0.341 acre, more or less, according to
a survey made by N. Eugene Kelley on January 13, 1999 and shown on plat entitled “Plat Showing
the Property of Darryl Austin.”
AND BEING the same real estate conveyed unto Greenbrier Premier Rentals & Property, LLC, a West Virginia Limited Liability Company, from Mark Grim, by deed dated June 21 , 2021, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 634 at page 421.
TRACT THREE:
All that certain real estate, together with the buildings and improvements located thereon, and the rights-of-way, easements and appurtenances thereunto belonging, situate, lying and being in Lewisburg District, County of Greenbrier, State of West Virginia, and being more particularly bounded and described as follows:
A certain tract or lot designated as Lot # 7 of Estates of Greenbrier Subdivision, situate in Lewisburg
District, Greenbrier County, West Virginia, at Maxwelton and being more particularly described as
follows:
BEGINNING at a 1/2” rebar, corner to Lot # 6 in the East right of way line of 40.00 foot wide right of
way, thence with said right of way, N 01 02719” E 108.16 feet, to a h” rebar, thence with a curve to
the right having a delta angle of 88o35’55”, radius of 79.93 feet, chord of N 45o45’16” E 111.65
feet for 123.60 feet, to a 1/2” rebar, thence; S 89o5646” E 114.41 feet, to a 1/2” rebar, thence with a
curve to the right having a delta angle of 97o28158” radius of 40.00 feet, chord of S 41o12’71” E
60.14 feet, for 68.06 feet, to a 1.2” rebar and to the West right of way line of a 30.00 foot wide right
of way, thence; S 07o32’12” W 178.66 feet, to a 1/2” rebar, corner to Lot # 6, thence; N 80o 18’ 17”
W 216.41 feet, to the beginning containing 1.02 acres, more or less.
THERE IS HEREBY EXCEPTED AND RESERVED a 15 foot wide utility easement along the
road frontage of the herein described property. This easement is for the installation, repair, mainten-
ance and replacement of any and all utility facilities, including but not limited to electrical power
lines, telephone lines, television cables, water lines, sewer lines, and gas lines.
THIS CONVEYANCE IS MADE SUBJECT TO THE FOLLOWING RESTRICTIONS
WHICH SHALL RUN WITH THE PROPERTY:
(1) No trailer, mobile home, double wide or manufactured homes shall be allowed on the property.
(2) Any home constructed upon the property shall contain a minimum of 1,800 square feet of heated
living space.
(3) The GRANTEE shall maintain this property in a neat and orderly condition and shall not allow
the lawn or landscaping to become unsightly or overgrown. The predecessors in title by that
certain Deed dated September 20, 2005, recorded September 28, 2005, as Instrument 25907
in Deed Book 501, at Page 256, reserved unto themselves or their assigns, the right of have this
property mowed in the event that property has become overgrown and it shall be the Grantees
responsibility to pay for this service.
AND BEING the same real estate conveyed unto Greenbrier Premier Rentals & Property, LLC,
from Cendlelyn Workman, by deed dated June 21, 2021, and of record in the Office of the Clerk of
the County Commission of Greenbrier County, West Virginia, in Deed Book 634 at page 425.
TERMS OF SALE: The referenced real property will be conveyed by deed with no covenants of warranty of title. The real property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes and liens with priority to the deed of trust pursuant to which this sale is being conducted. The property will be sold subject to all covenants, restrictions, easements, rights of ways and reservations which may be of record in aforesaid Clerk’s office. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (cost of tax stamps to be affixed to deed).
The Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
