NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 25, 2001, executed by the Borrowers, Leo H. Goss, Jr. and Sheila J. Goss, to Janet Phillips, the Trustee, of record in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Book 163, at Page 335. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 223 Virginia St., Parsons, WV 26287. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated October 9, 2019, of record in the Clerk’s Office in Book 293, at Page 389. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property, together with the improvements thereon and the appurtenances thereunto belonging, to the highest bidder at the front door of the Courthouse of Tucker County, in Parsons, West Virginia, on the following date:
November 26, 2019 at 1 :30 p.m.
Part of Lot No. Six (6) in Block 2 of the Wingfield Addition, fronting 40 feet on Merrill Street and running back at even width 70 feet to the rear, bounded on the one side by Lot No. 7 in Block 2 of the Wingfield Addition and bounded on the other side by Lot No. 5 in Block 2 of the said Wingfield Addition and bounded on the rear by the residue of the said Lot No. Six (6), said parcel conveyed being 40 feet by 70 feet, being part of the same real estate conveyed unto the parties of the first part by deed of Merl Goss (widow), bearing date of February 25, 1982, and of record in the Office of the Clerk of the County Commission, Tucker County, West Virginia in Deed Book No. 99 at page 656.
Lot No. 5 in Block 2 of the Wingfield Addition to the City of Parsons, being the same interest devised unto Margaret K. Chambers, one of the first part under the Will of Leo H. Goss, Sr., which Will is of record in the said Clerk’s Office. in Will Book No. 12, at page 499, the said lot having been originally conveyed unto Leo H. Goss, Sr. and Irene W. Goss, husband and wife, as joint tenants with full right of survivorship and not as tenants in common, by deed of Irene W. Goss and Leo H. Goss, Sr., bearing date of December 5, 1991 and of record in the Office of the Clerk of the said Clerk’s Office in Will Book No. 138, at page 239, that Irene W. Goss, pre-deceased her husband, Leo H. Goss, Sr. upon her death, the said lot vested in Leo H. Goss, Sr. her husband under the survivorship conveyance.
Part Lot No. 6 in Block 2 of the Wingfield Addition to the City of Parsons, being the residue of Lot No. 6 the other part of
Lot No. 6 Block 2 of the Wingfield Addition having been conveyed unto Leo H. Goss, Jr. and Sheila J. Goss, husband and wife, by deed of Leo H. Goss, Sr., and Irene W. Goss, husband and wife, by deed bearing date of December 3, 1991 and of record in the Office of the Clerk of the County Commission, Tucker County, West Virginia in Deed Book No. 137, at page 270, the interest herein conveyed being the same interest devised unto Margaret J. Chambers, one of the parties of the first part under the Will of Leo H. Goss, Sr., which Will is of record in the said Clerk’s Office in Will Book No. 12, at page 499, the said Lot No. 6 in Block 2 Wingfield Addition having been conveyed unto Leo H. Goss (aka Leo H. Goss, Sr.) and Irene W. Goss, husband and wife, as joint tenants with full right of survivorship by deed of Merl Goss bearing date of February 25, 1982 and recorded in said Clerk’s Office in Deed Book No. 99, at page 656 and that Irene W. Goss, pre-deceased her husband Leo H. Goss, Sr. and upon her death the said Part Lot No. 6 Block 2 Wingfield Addition herein conveyed, vested in Leo H. Goss, Sr., her husband under the survivorship conveyance.
Part Lot No. 7 in Block 2 of the Wingfield Addition to the City of Parsons, which said part lot fronts 65 feet on Virginia Street and extend back at even width 45 feet, being the same interest in said part lot devised unto Margaret K. Chambers, one of the parties of the second part under the Will of Leo H. Goss, Sr. which Will is of record in the said Clerk’s Office in Will Book No. 12 at page 499, and being the same interest in said part lot conveyed unto Leo H. Goss, Sr. by two deeds: (1) By deed of Charles W. Hebb (single) bearing date of May 6, 1950 and of record in the said Clerk’s Office in Deed Book No. 62, at page 333 and (2) by deed of Elloween L. Goss (divorced), bearing date of July 3, 1973 and of record in the said Clerk’s Office in Deed Book No. 83, at page 646.
BEING, in part, the same real estate conveyed unto Leo H. Goss, Jr. and Sheila J. Goss by the Deed dated December 3, 1991 and recorded in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Deed Book 137, at Page 279; AND BEING, in part, the same real estate conveyed to Leo Goss, Jr. by the Deed dated June 6, 1995 and recorded in the aforesaid Clerk’s Office in Deed Book 148, at Page 488.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty,
express or implied, subject to the Internal Revenue Service right of redemption, all property taxes,
prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants,
conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia
Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for
the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or
oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to
vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE
DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten
