NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee(s) by that certain Deed of Trust dated February 20, 2009, executed by Borrower(s) to the Trustees, of record in the Clerk’s Office in Book 645, at Page 621, and further by that certain Modification of Deed of Trust, dated September 12, 2014, executed by Borrower(s) to the Trustees, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 736, at Page 409. Edward D. Knight, III, was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 19,2020, of record in the Clerk’s Office in Substitution of Trustee Book 825 at page 36. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on:
TUESDAY, JUNE 23, 2020, AT 10:00 AM
The property is described as that certain lot, tract or parcel of land, situate in Irish Corner District, Greenbrier County, West Virginia, and according to a survey made by Greenbrier Surveying Company, Inc., on October 16, 1990, more particularly bounded and described as follows:
“BEGINNING at a 3/4 inch iron pipe set 20 feet from the center
and on the west side of U. S. Route 219 and from which a line bears
S 11-57 W 34.70 feet to a Vepco pole #R70; thence leaving U.S.
Route 219 and through the property of Harry Vance, S 80-44W
236.84 feet to a 3/4 inch iron pipe, set; thence continuing through
the Vance tract, N 06-48 W 292. 21 feet to a 3/4 inch iron pipe, set
and from which a line bears N 65-25 E 40.37 feet to an 18 inch
white oak and a line bears S 74-12 E 10.67 feet to the center of a
water well casing; thence continuing through the Vance tract, N 28-
21 E 338.55 feet to a fence post on the line of L. Sarver; thence
with the line of Sarver and with a wire fence, S 56-02 E at 65.70 feet
passing a fence comer post, in all 69.62 feet to a point 20 feet from
the center of U.S. Route 219; thence leaving Sarver and with U.S.
Route 219, S 05-34 E 513.49 feet to the BEGINNING and
containing 2.49 acres.”
And being the same property conveyed unto Donald Holliday and Drema Holliday, his wife, or the survivor, by Harry Lee Vance and Rose Marie Vance, his wife, by deed dated the 24th day of September 1991, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 409 at page 496.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code§ 11-22-2.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.
