NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated November 7, 2014, from Michael Shane Johnston and Catherine Rachel Johnston to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book No. 741, at page 89, and Trust Deed Book No. 739, at page 741, securing a promissory note in the principal amount of $65,922.02, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on November 4, 2020 at 11:15 a.m., subject to all reservations, exceptions, casements and other matters which appear of record, and subject to all unpaid taxes, if any, a tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, being, located in the vicinity of Williamsburg District, Greenbrier County, West Virginia, and being more particularly bounded and described as follows:
Beginning at a 5/8-inch rebar with cap, found, said rebar being a
common comer of Sandy G. Depriest, Michael S. Johnston and
Catherine R. Johnston, said rebar also being N 45° 22’ 44” W 531.67
feet from a old wood fence post on the westerly side of Trout Road
(West Virginia County Route 10), said post being a common corner
of Sandy G. Depriest and Charles M. Long: thence with the
common lines of Sandy G. Depriest, Michael S. Johnston and
Catherine R. Johnston the following four (4) calls: S 15° 24’ 20”
W 424.99 feet to a 518-inch rebar with cap, found, said rebar being
S 85° 46’ 44” W 492.66 feet from a old wood fence post on the
westerly side of Trout Road (West Virginia County Route 10), said
post being a common comer of Sandy G. Depriest and Charles M.
Long: N 74° 39’ 26” W 210.70 feet to a 5/8-inch re bar with cap,
found: N 15° 34’ 50” E 425.22 feet to a 5/8-inch rebar with cap,
found: S 74° 35’ 40” E 209.40 feet to the POINT OF BEGINNING,
containing 2.05 acres, more or less, as shown on a plat prepared by
Southern Engineering and Surveying Company. Inc. titled “Plat
Showing Boundary Survey of a Tract of Land for Michael S.
Johnston and Catherine R. Johnston, Located in the Vicinity of
Williamsburg, Williamsburg District, Greenbrier County, West
Virginia. Scale: 1” = 100’, Date: October 15, 2014.”
There is included a 20’ right of way over existing drive for ingress
and egress.
Being the same property conveyed from Sandy G. Depriest and Rachel Depriest, husband and wife, to Catherine R. Johnston and Michael S. Johnston, wife and husband, by Deed dated June 12, 2007, of record in the aforesaid Clerk’s office in Deed Rook No. 520, at page 743.
Terms of the sale: Ten percent non-refundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
