TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Trustee, acting on the authority granted by that certain Deed of Trust, dated April 14, 2011, and duly recorded in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Trust Deed Book 126, at page 465, whereby Ryan Jarvis did convey unto James Bennett and Drew Patton, Trustee, certain real property particularly described in said Deed of Trust and, default having been made under the said Deed of Trust, the Trustee has been instructed, by the secured party, to foreclose under said deed-of-trust and will offer said real property for sale at public auction at the front door of the Clay County Courthouse in Clay, West Virginia, in accordance with said the deed-of-trust, on: March 18, 2020, at 2:00 p.m.
The subject property being: All that certain lot, tract or parcel of real estate, together with all appurtenances thereunto belonging and appertaining and all improvements thereon, lying and being situate on the waters of Two Lick Run, a tributary of Beech Fork, in the district of Washington, county of Calhoun, state of West Virginia, bounded and described as follows:
All that certain lot, tract, or parcel of land situate on the waters of the Crooked Run Fork of Stinson Creek, Otter District, Clay County, West Virginia: BEGINNING at an ash on the end of a point and corner toW. P. McMorrow tract and running thence N. 65 E 18 poles to a locust; N 1-1/2 E 40 poles to a white oak, walnut and stone; N 86-1/2 E 45 poles to a stake; N 20-1/2 E 27-1/2 poles to a white oak in a drain; N 51 W 23 poles to a chestnut oak on point of ridge; S 68 W 35 poles to a stone on West side of road; N 55 W 11 poles to a stone; S 9 W 17-1/2 poles to a stone at run; S 58 W 12 poles to a stone; S 85 W 18 poles to a small poplar; S 44 W 36 poles to a stone; S 30 E 43 poles to a stone on the hill, and thence N 80 E 20 poles to the place of beginning, containing 29 acres and 127 poles, more or less.
There is herein INCLUDED in this conveyance, that certain 2004 Fleetwood Vogue mobile home #VAFL319A59695V513, to be located on the subject property.
BEING the same real estate conveyed unto Ryan Jarvis by Margaret Moore and Phyllis Park (formerly Phyllis Green) by Deed dated April 14, 2011, and of record in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Deed Book 208 at page 538.
The mobile home portion of this sale is also authorized by that certain Consumer Security Agreement dated April 14, 2011, executed by Brittany N Delaney to secure Calhoun County Bank Inc., Lender.
The subject property will be sold in “AS IS” condition. The Trustee and the secured party shall be under no duty or obligation to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: The above-described property will be sold by the undersigned Trustee or his agent by auction to the highest bidder, for cash in hand on the day of sale or under any different, other, or additional sale terms as he or as Lender, in reasonable discretion, may determine to be appropriate or advisable.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The Trustee reserves the right to continue the sale, or to adjourn the sale, without further notice other than by posting, or by oral announcement at the time and place of sale as set forth above.
