TRUSTEE’S SALE
By virtue of that certain Deed of Trust executed by Larry R. Yanero, Sr., to Rock S. Wilson, Trustee, to secure the Bruner Land Company, Inc. of Byesville, Ohio, in the amount of Fourteen Thousand Nine Hundred Seventy Dollars and Ninety-Seven Cents ($14,970.97) being dated December 7, 2010, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 994 at page 83, and default having been made in the payment of the indebtedness thereby secured, and upon request of the secured creditor under said Deed of Trust, the undersigned Trustee will sell, at public auction, to the highest bidder, on the 6th day of May, 2015, at 10:00 A.M., at the front door of the Court House of Marion County, in Fairmont, West Virginia, that certain lot, tract or parcel of real estate situate in Mannington District, Marion County, West Virginia, containing 19.69 Acres, more or less, and more particularly bounded and described as follows:
BEGINNING at a point in the center of Secondary 13/1, in a line and a corner to Consolidation Coal Company, thence leaving said road and with the same; S-69-45-E passing a 5/8” iron rod set at 20.01’ passing a 5/8” iron rod set at 338.17’ passing a 5/8” iron rod set at 1756.60, in all a total distance of 2027.62’ to a 5/8” iron rod set in a line of Constance T. Hall; thence leaving Consolidation Coal Company and with Hall; S-68-24-W passing a 5/8” iron rod set at 582.63’ in all a total distance of 1222.63’ to a 5/8” iron rod set; thence N-25-50-W passing a 5/8” iron rod set at 222.70’ in all a total distance of 1057.50’ to a 5/8” iron rod set; thence S-67-57-W 528.0’ to a 5/8” iron rod set, a corner to Lot 2; thence leaving Hall and with Lot 2, N-21-06- W passing a 5/8” iron set at 318.06’ in all a total distance of 333.07’ to a point in the center of Secondary 13/1, in a line of Consolidation Coal Company; thence leaving Lot 2 and with Secondary 13/1, N-75-28-E 87.72’ to a point; thence N-80-05-E 95.76’ to a point; thence N-72-08-E 82.17’ to a point; thence N-63-22-E 52.68’ to the place of beginning, containing 19.69 acres, more or less, and more fully shown on a plat prepared by Prine Land Surveying.
BEING the same real estate conveyed unto Larry R. Yanero, Sr. by that certain Deed from Bruner Land Company, Incdated the 7th day of December, 2010, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1073 at page 838.
The aforesaid will be sold subject to any unpaid taxes and existing building restrictions, restrictive covenants, exceptions, reservations, easements and servitudes to which said property has been heretofore subjected.
A special warranty deed will be issued to the purchaser.
The undersigned reserves the right to reject any and all bids.
Said sale may be adjourned from time to time by mere oral proclamation at the time and place of sale.
The proceeds of said sale will be used for the payment of outstanding real estate taxes and balance applied to payment of said Deed of Trust.
TERMS OF SALE: Cash in hand on day of Sale.
