NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated March 16, 2018, from Catherine Ann Atha to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Clay County, West Virginia in Trust Deed Book No. 142, at page 440, securing a promissory note in the principal amount of $108,998.00, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Clay County Courthouse in Clay, West Virginia on September 26, 2025 at 3:00 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain real estate, together with the improvements thereon and appurtenances thereunto belonging, survey description for a 28’ x 68’ Box Size Doublewide Home to be placed on a 1.52 Acre Parcel, more or less, owned by CATHY ATHA. Deed Book 219, Page 44 – Tax Map 26 Parcel 80. Situate at 178 Fitzwater Road, Lizemore 25125 in the Pleasant District, Clay County, West Virginia. Boundary shown on Plat of Survey by Timothy L. Keely – WVPS No. 972 … dated February 20, 2018. Being more particularly described as follows:
1.52 Acre Description;
Beginning at a point at old deed call of set stone (now gone) on top of ridge on the eastern line of Amherst
Industries, Inc. (Deed Book 134, Page 119 – Tax Map 26 Parcel 119), thence with said line along the ridge
S 72° 38’26”W, 66.00’ to a corner point at old deed call of a set stone (now gone) near a black oak on the
ridge; thence leaving Amherst, and now running down the hill with Richard W. Fitzwater (Deed Book
104, Page 323 – Tax Map 26 Parcel 112), N 3° 00’00”W, 886.53’ to a 18” Ash tree; thence along the
hillside N 81° 35’01”W, 34.00’ to a 5/8” rebar set; thence along the bottom crossing Fitzwater Road N 3°
00’00”W, 110.00’ to a 5/8” rebar set on the northern right of way of said road; thence with said right of
way S 81° 35’01” E, 34.00’ to a concrete post found corner to Wanda Taylor (Deed Book 92, Page 367 –
Tax Map 26 Parcel 113); thence leaving Fitzwater, and now running with Taylor, re-crossing said road S
71° 07’02”E, 68.90’ to an old 3” iron pipe found on the southern right of way of said road; thence leaving
the road and now running with an old fence joining Taylor back up the hill S 3° 00’00”E, 954.30’ to the
point of beginning, containing 1.52 Acres, more or less.
Commonly known as: 178 Fitzwater Road, Lizemores, WV 25125.
Together with a certain 2018 CMH Manufactured Home, Serial Number CAP031446TNAB.
Being the same property conveyed from Richard W. Fitzwater and Shirley Fitzwater to Cathy Atha by Deed dated August 2, 2017, of record in the aforesaid Clerk’s office in Deed Book No. 219, at page 44.
