The undersigned, Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 26, 2020, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1254, at Page 557, LOUIS FINDO, JR., did convey unto Michael L. Solomon, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by THE UNITED FEDERAL CREDIT UNION to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on
AUGUST 4, 2021
AT 10:00 A.M.
All of that certain lot or parcel of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Grant District, Marion County, West Virginia, formerly known as Watson, and being more particularly bounded and described as follows:
BEGINNING at a 1/2″ iron pin set on the southern edge of Meadowlane Avenue, corner to Nickles Bakery, Inc.; thence with one line of the same S. 16 degrees 35′ 10″ W. 184.03 feet to a 1/2” iron pin set, corner to Anthony Poster; thence with line of Poster N. 68 degrees 44′ W. 108.41 feet to a 1″ pipe found, corner to Ruth Howard; thence with line of Howard N. 19 degrees 41′ 50″ E. 183.34 feet to a 1/2″ iron pin set on the southern edge of Meadowland Avenue, corner to Howard; thence with the southern edge of Meadowlane Avenue, S. 68 degrees 49′ E. 98.42 feet to the place of beginning containing 0.435 acres.
And as shown on a map or plat by Paul D. Harbert, LLS, dated January, 1995, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 923, at page 942.
And being the same real estate conveyed to Louis Findo, Jr. by deed from Louis Findo, Sr., by deed dated December 14, 2005, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1008, at page 955, to which deed and plat reference is here made for all pertinent purposes.
This conveyance is made subject to all reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title.
TERMS OF SALE:
1) The property will be conveyed in “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.
