the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 12 – Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:
TRACT ONE:
Beginning at a 1" rebar set at the intersection of the West R/W line of the Orchard Lane and North R/W line of Route 99; thence with North R/W of Route 99, S. 89 23 24 W. 61.39 feet to a 1" rebar set on the corner of lots No. 12 & 11; thence continuing with North R/W of Route 99, N. 89 10 14 W. 30.05 feet to a 1" rebar set on lot No. 11; thence leaving Route 99, and running through lot No. 11, N. 01 19 53 E. 67.12 feet to a 1" rebar set; thence, running through lots No., 11 & 12, S 88 40 07 E. 84.84 feet to a 1" rebar set in West R/W of Orchard Lane; thence, with West R/W of Orchard Lane, S. 04 27 E. 65.11 feet to the point of beginning containing 0.134 acres, and being shown on a map entitled, "Plat of Survey of Lots 10, 11 & 12 of the Orchard Addition of the Charles Stansbury Subdivision, in Trap Hill District, at Glen Daniel, Raleigh County, West Virginia, and recorded in Map Book 7, on Page 147, Showing Portion to be conveyed to Ronnie D. and Della R. Jenkins, and Portion to be conveyed to Dale and Bertha Tackett, Date: 02/24/97, Ira Brooks, WVLLS 156, Scale: 1" = 20', the said map being attached hereto and made a part hereof.
TRACT TWO:
The surface, with any appurtenances thereunto belonging, of those certain lots or parcels of land situate in the Orchard Addition of the Chas. Stansbury Subdivision, Trap Hill Tax District, Raleigh County, West Virginia, as shown on a map of said subdivision of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 7, page 147; and being Lot No. 10 and the western part of Lot No. 11 adjacent to Lot No. 10, and the said part of Lot No. 11 hereby conveyed fronts 35 feet on the Glen Daniel-Bolt Road and is 35 feet wide on the rear on Orchard Lane, and extends back along Lot No. 10.
And being the same property obtained by Patricia Green by Deed dated the 21st day of October, 2016, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5063, at Page 6313.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 414 Bolt Rd, Glen Daniel, WV 25844-4400.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
