TRUSTEE’S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 18, 2002, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 661, at Page 373, Ann Gunnoe aka Margaret Ann Gunnoe did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on
December 11, 2019, at 3:02 p.m.
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Smithers District, Fayette County, West Virginia, and more particularly described as follows:
Lot No. 27 as shown on a map captioned “Map of the Campbell Subdivision- a Southern Extension to the City of Smithers, W.Va., prepared by W. R. Wise, R. P.E., dated July 9, 1958, which said map is of record in the Office of the Clerk of the County Court of Fayette County, W.Va.”
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 144 Beech Street, Smithers, WV 25186.
AND BEING the same real estate which was conveyed to Roy Gunnoe and Pauline Gunnoe by Deed dated July 17, 1958, from J. Campbell Craver, Katherine Mann Craver, and The Charleston National Bank, as Trustee under the Will of Ada M. Craver, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 216, at Page 337. The said Roy Gunnoe passed away from this life on November 27, 1990 and pursuant to the survivorship provisions of the aforementioned Deed, title vested in Pauline Gunnoe. The said Pauline Gunnoe passed away from this life on July 7, 1998 and pursuant to her Last Will & Testament, of record in Book 57, at Page 433, title vested in Ann Gunnoe aka Margaret Ann Gunnoe.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
