The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 3, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50282088, in Book No. 5028, at Page 2088, Thomas W Atkins did convey unto Michael Raber, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 5, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Carrington Mortgage Services, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

All of that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, as follows:
Situated in the State of West Virginia, County of Raleigh an din the District of Trap Hill, beginning on the Eastern right-of-way line of the Maple Road, thence N. 71 deg. 37′ E. 342.62 feet to a stake on the outside line of the Mankin Property; thence with the outside line of the Mankins Property S. 15 deg. 03′ E. 183.26 feet to a stake; thence S. 8 deg. 35′ W. 230.0 feet to a stake on the Eastern right of way line of the Maple Meadow Road the Three following calls: N. 48 deg. 10′ W. 68.0 feet to a stake; thence N. 60 deg. 40′ W. 132.0 feet to a stake; N. 46 deg. 00′ W. 170.00 feet back to the point of beginning and containing 1.34 acres, more or less, and being more particularly shown on that certain map recorded with that deed dated the 5th day of August 1981, made by Clyde G. Mankins and La Cleda Mankin, his wife, of record in the Office of the Clerk of the County Commission of Raleigh County, in Deed Book 645, at Page 818. Said map is entitled “Plat of Clyde G. Mankin Pro. Maple Meadow Raleigh Co. WVA.,” and which said map is dated August 2, 1981, survey by Franklin D. Accord, County Surveyor, Raleigh County, West Virginia, and Scale 1″ = 200′.

This conveyance is made subject to any and all exceptions, agreements, restrictions, covenants, easements and rights of way set forth in prior deed of records. Prior conveyance by Deed bearing date the 19th day of January, 2000 and of record in the Office of the Clerk of the County Commission of Raleigh County, WV, in Deed Book 5001, Page 6468.
Being the same property conveyed to Randall Murphy III and Jackie N. Murphy, husband and wife joint tenants with the rights of survivorship by deed from Heather D. Simmons and Joshua D. Simmons, wife and husband recorded 10/24/2005 in Deed Book 50198004, Page , in the Clerk’s Office of the County Commission of Raleigh County, West Virginia. Tax ID # 12-24-19.1
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1189 Rockhouse Road, Lester, WV 25865.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
