The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 25, 2013, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2013013526, in Book No. 917, at Page 107, Timothy R Sizemore did convey unto Mike Day and James C. Blankenship, III, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 30, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:

The following described tracts or parcels of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:
Parcel No. 1: The surface of Lots Nos. 29 and 30 of the Oak Hill Truck Farms, near the Town of Oak Hill, Fayetteville District, Fayette County, West Virginia, as shown by a map thereof recorded in the Office of the Clerk of the Fayette County Commission with a deed from J. H. Lilly Land Company to Everett Smith and Louise Smith, dated January 26, 1937, and of record in Deed Book No. 84 at Page 487, the map being recorded in Map Book 4, at Page 192, to which said deed and map reference is here made. The said lots together front 200 feet on Center Street and extend back therefrom with Lot 28 a distance of 175.28 feet to Lot 48, and back on the opposite side with Lot 31, a distance of 178.95 feet to Lot 47, bordering on the rear of said Lots 48 and 47, a distance of 200 feet.
Parcel No. 2: The following described lots or parcels of surface land, together with improvements thereon, appurtenances thereunto belonging and rights incidental thereto, situate in the City of Oak Hill, Plateau District, Fayette County, West Virginia, and being more particularly designated as described as follows: BEGINNING at an iron pin on the western side of Center Street, and common corner of Lots 31 and 32; thence leaving Lot 32 and with the western side of said street, S. 12-06′ W 120 feet to an iron pin, common corner of Lots 30 and 3; thence leaving said Center Street and with the common line of Lots 30 and 31, N. 77-54′ W. 148.27 feet to an iron pin, new corner of Lots 31 and 46; thence leaving Lot 30 and with a new line through Lot 31, N. 11-08′ E, 120 feet to an iron pin on line of Lot 32, and being the new corner of Lots 31 and 46; thence with the common line of Lots 31 and 32, S. 77-54′ E. 150.43 feet to the place of beginning, and containing 17,922 square feet, or 0.411 of an acre. Being a part of Lot No. 31 of the Oak Hill Truck Farms as shown on a map recorded in Map Book 4 at Page 192.
And being the same real estate which was conveyed unto Timothy Richard Sizemore by deed of Gary Ray Treadway, et als, dated the 17th day of July, 2013, and to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously with the recording of this instrument.
The deed of trust is made and accepted subject to all validly continuing reservations, restrictions, conditions, covenants, easements and rights of ways made and contained in all prior deeds in the chain of title to the above-described property.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 160 Center Street, Oak Hill, WV 25901.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
