TRUSTEE’S SALE OF VALUABLE REAL ESTATE

FRIDAY, JUNE 26, 2015, AT 10:00 A.M.

The herein described real estate of the Estate of Helen L. Churchill, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Friday, June 26, 2015, at 10:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Helen L. Churchill, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 18th day of May, 2006, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 423, at Page 490. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustees, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Friday, June 26, 2015, at 10:00 a.m., which said property is more particularly described as follows:

All that certain tract or parcel of real estate lying in Gore District of Hampshire County, West Virginia, along the west side of Route 3/9, approximately 3/4 mile North of Route 3, which real estate is more particularly described as follows:

“Beginning at a 5/8” Re-Bar set in the line of Laura Belle Fisher, thence with said line,
S. 62 15 40 E. 322.50’ to the center of Route 3/9, thence with the road,
S. 37 03 20 W. 103.87’,
S. 33 35 14 W. 68.26’ to the corner of an 0.958 Acre tract, thence with said tract,
N. 51 21 41 W. 277.52’ to a 5/8” Re-Bar, thence with a new line of division through the Lease Land,
N. 15 12 15 E. 120.81’ to the beginning, containing 0.979 acres as surveyed by Frank A. Whitacre, September 10, 1982.

And being the same real estate which was conveyed unto Robert P. Simerly, Sr. and Helen L. Simerly, his wife, who is now Helen L. Churchill, by Deed of Roger Lee McBride, single, by Deed dated the 24th day of June, 1991, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed Book No. 327 at page 269. And further being the same real estate in which full, fee simple title did vest in Helen L. Simerly, now Helen L. Churchill, upon the death of her husband, Robert P. Simerly, Sr., on January 12, 2004, per the survivorship clause in said deed. The said Helen L. Churchill died January 25, 2014.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
