TRUSTEE’S SALE OF VALUABLE REAL ESTATE

WEDNESDAY, JULY 22, 2015, AT 11:00 A.M.

The herein described real estate of Pamela S. Spaid shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Wednesday, July 22, 2015, at 11:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Pamela S. Spaid, unto William C. Keaton and/or W. Joseph Milleson, Jr., Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 7th day of August, 2013, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 562, at Page 502. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustees, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Wednesday, July 22, 2015, at 11:00 a.m., which said property is more particularly described as follows:

All that certain tract or parcel of real estate situate in Gore District of Hampshire County, West Virginia, on the drains of North River and North of State Route 45/9, more particularly described as follows:

Beginning at a fence post found in a line of the parent tract and Junior G. Kidwell (DB 106, Page 206), thence into the parent tract N. 89 38 48 E. 180.54 feet to a #4 rebar 18” long set 1” above ground, thence S. 6 17 26 E. still inside the parent tract 246.06 feet, to a #3 rebar 18” long set 1” above ground in the Northern Right of Way boundary of State Route 45/9 same course continued 0.82 feet to a 16 inch locust tree marked with two notches each side; the same course continued 14.19 feet in all 297.07 feet to the center of State Route 45/9 thence with the center line of said Road, S. 81 12 00 W. 254.08 feet to the line of Junior G. Kidwell, thence with the line of said Kidwell, N. 7 13 47 E. 15.60 feet to a #3 rebar 18” long set in the northern boundary of said road same course continued 1.04 feet to a corner fence post same course continued 301.04 feet with a woven fire fence 4½ feet high in all 317.68 feet to the beginning, containing 1.38 acres, taxable and 1.46 acres total, more or less, as surveyed by Kennis F. Snyder, Romney, WV in September, 1979, Magnetic Compass Declination is 8 43 30 taken at USCGS Monuments near Romney Grade School, Romney, WV, on 2 August, 1979.

And being the same real estate which was conveyed unto Larry E. Bittinger and Pamela S. Spaid by deed of William G. Heavner, Jr. and Patricia S. Heavner, his wife, dated February 7, 1990, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 316, at page 224. And further being the same real estate in which Larry E. Bittinger conveyed all of his right, title and interest unto Pamela S. Spaid by deed dated July 30, 2013, of record in the aforesaid Clerk’s office in Deed Book No. 516, at page 89. Said real estate is depicted on the Hampshire County Land Books as Tax Map 33, parcel 32.1 for said district.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustees reserve the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
