TRUSTEE’S SALE OF VALUABLE REAL ESTATE

WEDNESDAY, JULY 22, 2015, AT 10:00 A.M.

The herein described real estate of Daniel J. Woodall and Patricia A. Woodall, his wife, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Wednesday, July 22, 2015, at 10:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Daniel J. Woodall and Patricia A. Woodall, his wife, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 8th day of April, 2009, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 495, at Page 568. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Wednesday, July 22, 2015, at 10:00 a.m., which said property is more particularly described as follows:

All those two (2) certain tracts or parcels of real estate, situate in Romney District, Hampshire County, West Virginia, and being more particularly described as follows:

PARCEL ONE: All that certain tract or parcel of real estate lying about 250 feet southeast of Route 50 about ½ mile southwest of Route 5, containing 0.335 acres according to a recent survey prepared by Frank A. Whitacre, Licensed Land Surveyor, West Virginia License No. 506, said plat being of record in the Office of the County Clerk of Hampshire County, West Virginia, in Deed Book No. 305, at page 429. Said real estate is shown on the 2008 Hampshire County Land Books as being all of Tax Map 9, parcel 16.1 for said district.

PARCEL TWO: All that certain tract or parcel of real estate situate in Romney District of Hampshire County, West Virginia, described as containing 6.96 acres. And being all of the same real estate that was conveyed unto Nello K. Bucklew (aka Nello Knight Bucklew) by deed of Edna F. Bucklew, widow, dated the 2nd day of December, 1974, and of record in the aforesaid Clerk’s Office in Deed Book No. 209 at page 389, wherein said real estate is more particularly bounded and described as follows:

“Beginning at a big white oak, the corner between J. W. Shanholtzer and C. D. Hannas, thence with the public highway approximately 78 years to a locust marked with a blaze east of said highway; thence to a black oak blazed at the Bald Hill Road and in a straight line; thence with the Bald Hill Road to the line of C. D. Hannas; thence with his line to the big white oak at the beginning, containing eight (8) acres, more or less”.

LESS, HOWEVER, a tract or parcel therefrom which is being reserved by Edna F. Bucklew, grantor herein which is described as follows: Beginning at a point in the center of a private road, the second corner of a tract of 1.25 acres conveyed to Nello K. Bucklew by Edna F. Bucklew by deed of record in Deed Book 175, at page 299, thence with the center of said roadway on Nello Bucklew line, S. 69 28 E., 131 feet; S. 70 E., 84 feet; S. 49 E., 50 feet; thence leaving the road and said 1.25 acre tract, N. 40 15 E., 149.9 feet to a Cherry tree marked for a corner; thence, N. 53 50 W., 267.5 feet to the east side of U. S. Route No. 50; thence with the east side of said highway, S. 38 15 W., 204 feet to the beginning, containing 1.04 acres.

THUS LEAVING, for the purpose of this conveyance 6.96 acres, more or less. Said 6.96 acres is shown on the 2008 Hampshire County Land Books as being all of Tax Map 9, parcel 17 for said district.

And being all the same real estate which was conveyed Daniel J. Woodall and Patricia A. Woodall, his wife, as tenants in common, by deed of Patricia A. Woodall, dated the 18th day of Augusta, 2000, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 402, at Page 1.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
