TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 4, 2004, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50131918, in Book No. 5013, at Page 1918, Marlene Martien did convey unto Roop Smith and Roop, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 20, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Deutsche Bank National Trust Company, as Indenture Trustee for New Century Home Equity Loan Trust 2004-2 to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on September 24, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beckley District, Raleigh County, West Virginia, and more particularly described as follows: The surface of that certain tract or parcel of land, with any appurtenances thereunto belonging, situate on Worley Road, in the City of Beckley, Raleigh County, West Virginia, and being designated as Parcel No. 1, containing 9528.4 square feet or 0.219 acre on a map entitled “PLAT SHOWING DIVISION OF LANDS OF V. E. EVANS, JR. HEIRS”, which said map is attached to a deed dated June 26, 1976, from Gary L. Evans and Fern Evans, his wife, and Juanita A. Evans, single, to Alice Evans, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 567, at page 621, reference to which said map is hereby made for a more particular description of the tract or parcel of land hereby conveyed. Said tract or parcel of land hereby conveyed is more particularly bounded and described as follows: BEGINNING at a fence post in the north right-of-way line of Worley Road, which fence post is located N 85 f 00′ E 82.23 feet from the John T. Adams, Jr. and Evans corner; thence through property up until this time jointly owned by Juanita A. Evans, Vaden E. Evans, Jr. and Gary L. Evans, N 4 f 00′ 44″ E 150 feet to a set iron pin; thence N 85 f 37′ 58″ E 66.54 feet to a set iron pin in a fence line; thence with said fence line S 5 f 39′ 27″ W 150 feet to a found fence post in the fence line and in the north right-of-way line of Worley Road; thence with the fence line and the north right-of-way line of Worley Road S 85 f 00′ 00″ W 62.29 feet back to the point of beginning, containing 9528.4 scare feet or 0.219 acre, more or less. And being the same property acquired by Marlene E. Martien by deed dated July 10, 1995, from Gary L, Evans and W. Fern Evans, to be recorded in the aforesaid Clerk’s Office prior to or simultaneously herewith. A copy of any notice of foreclosure sale shall be served on Grantors by certified mail, return receipt requested at the following address: 403 Worley Road, Beckley, WV 25801, or at such other address as may be given to Lender in writing by Grantors subsequent to the execution and delivery of this deed of trust. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 403 Worley Road, Beckley, WV 25801. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $6,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
