TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 16, 2011, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50444595, in Book No. 5044, at Page 4595, Kendra Lee Brown and Jason Shawn Brown did convey unto Larrick Law Offices, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 24, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on September 24, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: The following parcel of land, together with improvements thereon, the easements thereto, and the appurtenances, thereon or belonging thereto, the surface of part of Lot No. 68 of Phase IV of the Big Beaver, Subdivision, Situate at Daniels, Shady Spring Tax District, Raleigh County, West Virginia, as shown on a map of said subdivision entitled ” PLAT OF LOTS 66, 67, AND 68, OF PHASE IV OF BIG BEAVER SUBDIVISION AT DANIELS, SHADY SPRING DISTRICT RALEIGH COUNTY, WEST VIRGINIA, OWNED AND DEVELOPED BY BIG BEAVER LLC BY JAMES E. COOK, INC. 361 PLUTO ROAD SHADY SPRING WV 25801 JANUARY 10, 2007 SCALE: 1″=60′ of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, as Instrument No. 5027-0082, and in Map Fil 4-447. And being the same property acquired by Jason S. Brown and Kendra L. Brown, by deed dated the 16th day of September, 2011, from Pioneer Community Bank, to be recorded in the County Clerks Office of Raleigh County, West Virginia, prior to or simultaneously herewith. EXCEPTED and RESERVED the following part of Lot 68: BEGINNING at a five-eights inch (5/8″) rebar on the northern right of way line of a 40 foot radius turning circle at the end of Red Fox Run at a common corner to Lots 67 and 68 of Phase IV of Big Beaver Subdivision; thence following said right of way line for an arc of 10.00 feet (chord: N 67 f 22′ 55″ W 9.97 feet); thence running through Lot 68, N 22 f 37′ 35″ E 203.87 feet to a one half-inch (1/2″) rebar at the rear common corner to Lots 29 and 30 of Phase II of Big Beaver Subdivision; thence following said Lot 29, N 60 f00′ 00″ E 52.91 feet to a one-half inch (1/2″) rebar at a common corner to Lots 29, 67, and 68 thence following the division line between Lots 67 and 68, S 27 f 46′ 48 W 246.57 feet to the point of Beginning and containing 0.103 acres, more or less At the time of the execution of the Deed of Trust, this property was reported to have an address of: 111 Red Fox Run, Daniels, WV 25832. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
