TRUSTEE’S SALE OF VALUABLE REAL ESTATE

THURSDAY, SEPTEMBER 24, 2015, AT 10:00 A.M.

The herein described real estate of the Bristol Springs, LLC, a West Virginia Limited Liability Company, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Thursday, September 24, 2015, at 10:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Bristol Springs, LLC, a West Virginia Limited Liability Company, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 11th day of April, 2007, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 448, at Page 452. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustees, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Thursday, September 24, 2015, at 10:00 a.m., which said property is more particularly described as follows:

All the remainder of that certain tract or parcel of real estate originally containing 135.73 acres, more or less, situate in Gore District, Hampshire County, West Virginia, as shown on that certain plat of survey prepared by H. Bruce Edens, Licensed Professional Surveyor, dated March 21, 2007, which said plat is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Map Book 10 at Page 276; said real estate has subsequently been subdivided into lots, which are now collectively known as Bristol Springs Subdivision, as depicted on the plats of said subdivision of record in the aforesaid Clerk’s Office in Map Book 11 at Page 53 (Section 1), Map Book 11 at Page 108 (Section 2), and in Map Book 11 at Page 109 (Section 3);

LESS AND EXCEPT THEREFROM all of the lots in Bristol Springs Subdivision which have heretofore been conveyed by Bristol Springs, LLC; which said previously conveyed lots are designated as follows:

Lots 2, 5, 6, 8, 10, 12, 13, 62, 64 and 66 of Bristol Springs Subdivision, Section 1; and

Lots 54, 56, 57 and 59 of Bristol Springs Subdivision, Section 3.

THUS, LEAVING, all the remaining lots in Bristol Springs Subdivision, which are designated on said plats as follows:

Lots 1, 3, 4, 7, 9, 11, 52, 61, 63 and 65 of Bristol Springs Subdivision, Section 1;

Lots 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 49, 50 and 51 of Bristol Springs Subdivision, Section 2; and

Lots 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 53, 55, 58 and 60 of Bristol Springs Subdivision, Section 3.

And being all of the remaining real estate which was conveyed to Bristol Springs, LLC, by deed of Dottie Moser Edwards, formerly Dottie Baker Moser, dated March 28, 2007, of record in the aforesaid Clerk’s Office in Deed Book 463, at Page 683.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
