TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 9, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50282352, in Book No. 5028, at Page 2352, Rodney L. Harless and Christine L. Harless did convey unto Richard A. Pill, Esq, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 4, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on October 1, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Marsh Fork District, Raleigh County, West Virginia, and more particularly described as follows: Those certain tracts or parcels of land situate in Marsh Fork District, Raleigh County, West Virginia, more particularly described as follows: Tract One: That certain tract or parcel of land situate in or near the Town of Rock Creek, Marsh Fork District Raleigh County, West Virginia, and being more particularly bounded and described as follows: BEING Lots No. Sixty-Nine (69), and Seventy (70) of the Clay Farms Subdivision No. 2 on Rock Creek, Marsh Fork District Raleigh County, West Virginia, as shown on a map prepared by George Miller, R.E. which said map is of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia in map Book No. 10 at page 63. Tract Two: The surface only of that certain part of Lot No. 71 of Clay Farm Subdivision No. 2, together with any appurtenances thereunto belonging, situate in the Clay Farm Subdivision No. 2, in Rock Creek, Marsh Fork District, Raleigh County, West Virginia and more Particularly bounded and described as follows: BEGINNING at a point on the southern right-of-way line of Third Street, said point being N 01 f 48′ 48″ W – 1.38 feet from a found pipe; thence leaving said southern right-of-way line and running through the lands of Lot 71 of Clay Farms Subdivision Number 2, the following three (3) calls: S 01 f 48′ 48″ E – 44.66 feet to a point: S 21 f 20′ 04″ E – 49.53 feet to a point S 32 f 10′ 01″ E – 56.88 feet to a point said point being on the northern right-of-way line of a 20 foot street: thence with said northern right-of-way line S 61 f 07′ 46″ W – 22.18 feet to a point, said point being the southern common corner of Lots 70 and 71; thence leaving said northern right-of-way line and with the common line of Lots 70 and 71 N 28 f 20′ 20’00 W – 181.09 feet to a point, said point being the northern common corner of said Lots 70 and 71 and a point on the southern right-of-way line of the aforementioned Third Street; thence with said southern right-of-way line S 80 f 03′ 00″ E – 56.51 feet to the point and place of beginning, containing 4,355 square feet or 0.10 acres more or less. And being the same property acquired by Rodney L. Harless and Christine L. Harless, by deed dated August 3, 2007, from Faye R. Pruett, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 125 Burgess Court, Rock Creek, WV 25174. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
