The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 24, 2001, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 345624, in Book No. 946, at Page 888, Ann M. Hines and Mikyl M. Hines did convey unto Carl H. Cather, III, Esq., Spilman, Thomas, & Battle, PLLC, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 3, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FEDERAL NATIONAL MORTGAGE ASSOCIATION to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

Lying and being situate on the waters of Badgley Creek, Tygart District, Wood County, West Virginia, and being more particularly described as follows: BEGINNING at a dead snag in fence corner, a common corner to the Loretto R. Auvil 10.39 acre tract as recorded in Will Book 56 Page 96, the George G. Wilson, Jr. 11 acre tract as recorded in Deed Book 870 Page 590, and the Donald E. and Betty J. Hoffman 83 acre tract as recorded in Deed Book 423 Page 92, also being the northeast corner to the Gordon N. and Margaret A. Monroe 18.37 acre tract as recorded in Deed Book 601 Page 586; thence with the easterly line of the said Gordon N. and Margaret A. Monroe 18.37 acre tract, S 01õ58á06ã W 449.77 feet to a 5/8ã rebar, set, from which a 14ã Butternut, found (Locust called for) an original corner to the said Gordon N. and Margaret A. Monroe 18.37 acre tract, from which a 26ã White Oak, found, bears S 59õ23á00ã W at 444.04 feet, the Northwest corner to the said Gordon N. and Margaret A. Monroe 18.37 acre tract; thence with the northerly line of the Gordon N. and Margaret A. Monroe 18.37 acre tract, N 59õ23á00ã E 712.69 feet to the place of beginning, containing 3.000 acres, as surveyed by James E. Lynch, PS.#1999 on March 5, 2000, as shown on the plat attached to that certain Deed of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1013 at page 762. Subject to all legal highways, rights of ways, and restrictions of record. Also granting to the grantee a right of way and easement for the purpose of sewer flowage discharge over, across, under and along the Gordon N. and Margaret A. Monroe 18.37 acre tract as recorded in Deed Book 601 Page 586. Also granting to the Grantee a 20-foot wide right of way for the purpose of ingress and egress. Beginning at a point in the northerly line of an existing 20 foot wide right of way as recorded in Deed Book 965 Page 575; thence N 11õ56á02ã E 49.44 feet to a point; thence N 01õ58á06ã E 185.51 feet to a point in the southerly line of the herein described 3.000 acre tract; thence with the southerly line of the herein described 3.000 acre tract, S 64õ48á38ã E 21.76 feet to a 5/8ã rebar, set, the southeast corner to the said 3.000 acre tract; thence with the easterly line of the Gordon N. and Margaret A. Monroe 18.37 acre tract as recorded in Deed Book 601 Page 586, S 01õ58á06ã W 178.67 feet to a point; thence leaving said easterly line of the Gordon N. and Margaret A. Monroe 18.37 acre tract as recorded in Deed Book 601 Page 586, S 11õ56á02ã W 45.75 feet to a point in the easterly line of the aforementioned 20 feet wide right of way as recorded in Deed Book 965 Page 575; thence S 86õ45á36ã W 20.72 feet to the place of beginning. Excepting and reserving a right of way and easement for the purpose of sewer flowage discharge over, across, under and along the herein described 3.000 acre tract. Also excepting and reserving the right of way and easement for sewer flowage discharge as recorded in Deed Book 972 Page 543. BEING the same real estate conveyed unto Mikyl M. Hines and Ann M. Hines, husband and wife, by Deed dated the 22nd day of March, 2000, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1013, at page 762. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 539 A Lost Pavement Road, Parkersburg, WV 26101.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
