TRUSTEES’ SALE OF VALUABLE REAL ESTATE The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated January 31, 1997, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 520, at page 664, Norma J. Simmons (deceased) and Paul E. Simmons did convey unto Richard W. Rhoades, Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Teays Valley Trustees, LLC as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, 100 Court Street, Fayetteville, West Virginia 25840 on: March 12, 2015 At 09:00 a.m. All of that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, and being the same property conveyed to Paul E. Simmons and Norma J. Simmons, his wife by Sewell Development Company by that certain Deed dated the 30th day of July, 1973 and recorded in the Office of the Fayette County Clerk, West Virginia in Deed Book 315, Page 522 together with the improvements thereon and appurtenances thereunto belonging, situate, lying and being in or near the City of Oak Hill, Plateau District of Fayette County, West Virginia, and being more particularly described as follows: Lot 20, Section 3, Collinwood Acres, as shown more fully on a Map entitled, “Collinwood Acres, Section 3, Oak Hill, Plateau District, Fayette County, West Virginia,” Scale One Inch = 50 feet, April, 1972, which said Map is of record in the Office of the Clerk of the County Court of Fayette County, West Virginia, in Map Book 17, at Page 95, reference to said Map being here made for a more accurate description of the property being conveyed herein. 323 Collinwood Drive, Oak Hill, WV 25901 The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence. The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.
