The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 13, 2010, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 83569, in Book No. 677, at Page 206, John E. Ghiz did convey unto Alan H. Larrick, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 17, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
December 7, 2015 at 2:30 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lewisburg District, Greenbrier County, West Virginia, and more particularly described as follows:
All of that certain lot, tract or parcel of land to-gether with the buildings and improvements thereon, easements, rights-of-way, and appurtenances thereunto belonging, situate on the waters of the Greenbrier River, about three (3) miles northeast of the Town of Lewisburg, in Lewisburg District, Greenbrier County, West Virginia, known and designated as Lot No. 4 of Twin Springs Subdivision, and more particularly described as follows:
BEGINNING at a 1 inch pipe set situate on the line of the Vernon McFall 4 acre tract, a corner to Lot 1 of this survey, thence leaving the said McFall and with the Lot 1 line; N 36-37-53 E 183.11 feet, passing a corner to Lot 1 at 85.00 feet, to a point situate in the center of a 30.00 feet wide street designated as Twin Springs Lane, the said point being a corner to Lot 2 and on the line of Lot 3 of this survey, the said point also being situate N 36-37-53 E 15.31 feet from a 1-inch iron pipe set in the right of way of the said lane; thence leaving Lot 2 and with the Lot 3 line; S 41-43-47 E 188.88 feet to a point situate in the center of said lane, a corner to Lot 5 of this survey; thence leaving Lot 3 and with the Lot 5 line, S 36-37-53 W 145.00 feet to a 1-inch iron pipe set, situate on the line of the Vernon McFall 4 acre tract; thence leaving Lot 5 and the said lane and with the Mcfall line; N 53-22-07 W 185.00 feet to the point of BEGINNING and containing 0.70 acres, more or less, as shown on a map entitled “Map Showing the Twin Springs Subdivision” and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Map Book 4, at hanging file 105A.
This conveyance is made SUBJECT to any and all restrictions, covenants, conditions, easements and rights of way running with the title to the property hereby conveyed that may be a matter of record in the Clerk’s Office and specifically to those restrictions, covenants and conditions contained in the “Declaration of Restrictive Covenants for Twin Springs Subdivision” of record in the Clerk’s Office in Deed Book 437, at Page 31; provided however, that any such restriction, covenant or condition indicating a preference, limitation or discrimination based on race, color, religion, sex, handicap, familial status or national origin is hereby deleted to the extent such restriction, covenant or condition violated 42 USC 3604(c).
And being the same property conveyed unto Thomas H. Williams from Julie D. Honaker McClung and Ralph McClung, wife and husband, by deed dated May 5, 2006, recorded in the Office of the Clerk of the Greenbrier County Commission in Deed Book 505, at page 603.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2992 Brush Rd, Lewisburg, WV 24901.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
