TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated December 2, 2000, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 281, at Page 471, and by Modification Agreement in Book 548, at Page 645., William M. Pratt and Penny L. Pratt did convey unto T. Sam Scipio and James E. Carskadon, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office in Book 592, at Page 287; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse, in Romney, West Virginia, on

Monday, December 14, 2015, at 4:03 p.m.

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Capon District, Hampshire County, West Virginia, and more particularly described as follows:

All that tract or parcel of real estate containing a dwelling house thereon, situate, lying, and being in Capon District, Hampshire County, West Virginia, located and described as follows:

BEGINNING at No. 2 an iron stake in the west bounds of State Route No. 13 known as the Christian Church Road and also the second corner to the apartment building lot thence, with the west bounds of said road S. 36 dew. 45’ W. 150 ft. to No. 2 an iron stake in the west bounds of the said road thence, cutting into the tract N. 54 deg. 30’ W. 126.6 ft. to No. 3 an iron stake in the cleared land; thence, N. 22 deg. 55’ E. 150 ft. to No. 4 an iron stake, also corner to the apartment lot; thence with the line of said lot reversed S. 55 deg. 35’ E. 162.8 ft. to the beginning, containing 21,700 sq. ft. or .498 of an acre.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Rt. 13, 498 Christian Church Rd., Capon Bridge, WV 26711.

AND BEING the same real estate which was conveyed to William M. Pratt and Penny L. Pratt, by Deed dated December 1, 2000, from Rebecca R. Nitz, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book, 403 at Page 89.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
