TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 25, 2013, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Document No. 149493, in Book No. 559, at Page 556, Denver E. Kidwell and Joan E. Kidwell did convey unto Robert Alan Milner, Esq, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 1, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Live Well Financial, Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Gore District, Hampshire County, West Virginia, and more particularly described as follows:

That certain tract or parcel of real estate containing 2.202 acres, more or less, situate in Gore District of Hampshire County, West Virginia, lying on the drains of Little Capon River and on the west side of County Route 3/3 approximately 3 miles Southeast of Levels, West Virginia, which real estate is more particularly described by metes and bounds according to a survey description prepared by C. W.W. Stultz, licensed land surveyor, as follows:

Beginning at an iron stake place 15 feet off the center of the County Road and on the West side thereof South 40 degrees – 37 minutes 49 seconds West 354.14 feet to a fence post marking the South East corner of a cemetary lot on the West side of said road. Thence South 87 degrees – 51 minutes – 54 seconds West 520.96 feet to another iron stake corner to C.W. Watson. Said corner is located South 37 degrees 58 minutes -12 seconds East 257.51 feet to the North corner post of the cemetary lot. Thence North 32 degrees – 19 minutes- 24 seconds East 351.55 feet to another iron stake on the North edge of a drain; thence with said drain South 65 degrees – 19 minutes- 49 seconds East 360.01 feet to another iron stake 15 feet off and West of the Center line of said County Road. Thence with said road and Western side thereof South 02 degrees- 27 minutes- 33 seconds East 127.52 feet to the place of beginning. Containing 2.202 acres, more or less, as Surveyed by C.W.W. Stultz, Licensed Land Surveyor.

Being the same property conveyed unto Denver E. Kidwell and Joan E. Kidwell, husband and wife, as joint tenants with rights of survivorship by Deed dated June 18, 1976, recorded July 13, 1976, in Book 217, Page 345.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: HC 60 Box 113-2, Points, WV 25437 aka 3131 Little Cacapon Levels Road, Points, WV 25437.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
