TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 29, 2007, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 44969, in Book No. 610, at Page 635, Teressa Morosine and Michael L. Morosine did convey unto Richard A. Pill and David D. Pill, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 3, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Ditech Financial LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on December 21, 2015 at 2:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Frankford District, Greenbrier County, West Virginia, and more particularly described as follows:
“Situate, lying and being Frankford Tax District, Central Magisterial District, Greenbrier County, West Virginia, on the north side of State Local Service Route 21 and about 1.1 miles from U.S. Route 219 at Frankford, more particularly described as follows:
TRACT ONE: Beginning at a fence post on the north side of S.L.S. Route 21, witness by a 3/4 inch iron pipe, set, and from which a line bears N 67-07 W 9.75 feet to a 26 inch black oak on the north side of the road and a line bears N 48-36 W 52.85 feet to a utility pole #26; thence with a wire fence and the north side of the road, N 60-11 W 168.33 feet to a point; thence N 61-28 W 132.18 feet to a fence post with a 3/4 inch iron pipe witness, set and from which a line bears N 72-41 W 220.66 feet to a 1 inch iron pipe on the south east corner of James D. Blackburn; thence leaving the road and through the property of Charles D. Blackburn, N 27-02 E 144.34 feet to a 3/4 inch iron pipe set in a field, and from which a line bears N 42-05 W 180.86 feet to a 1 inch iron pipe in the northeast corner of James M. Blackburn; thence continuing through the property of Charles D. Blackburn, S 59-51 E 297.51 feet to a 3/4 inch iron pipe set in a field; thence S 25-43 W 139.82 feet to the beginning and containing 0.97 acre, more or less, as surveyed by Greenbrier Surveying Company in January, 1983.”
There is excepted and reserved and not herein conveyed the following: Beginning at a fence post, on the line of Stephen J. Myles (DB 454, Pg. 246); thence with Stephen J. Myles, N 27-02-00 E 67.73 feet to a fence post found, 3/4 inch pipe called for, corner to said Stephen J. Myles and Robert B. Anderson, et ux (DB 459, Pg. 936); thence leaving said Stephen J. Myles, and with said Anderson, S 60-02-42 E 116.18 feet to 1/2 inch rebar and cap set, below a fence, said rebar and cap bears N 60-02-42 W 181.35 feet from a 1 inch iron pipe found, corner to said Anderson and Jo Anne Blackburn Myles (DB 423, Pg. 521 ); thence leaving said Anderson and through the property of Jo Anne Blackburn Myles and with a new division-line, S 27-02-00 W 47.49 feet to a 1/2 inch rebar and cap set in a fence line; thence continuing with a new division line, N 69-03-45 W 39.93 feet to a fence post; thence continuing with a new division line, N 73-28-40 W 62.46 feet to a fence post; thence continuing with a new division line, N 56-47-09 W 15.00 feet to the beginning and containing 0.156 acre, more or less, as surveyed by Greenbrier Surveying in June 2003; and being conveyed unto Stephen Myles by deed from Jo Anne Myles, dated June 16, 2003, and recorded prior to this deed. A parcel of land in Frankford District, Greenbrier County, West Virginia, and situated on the northern side of WV County Route No. 21 and more particularly bounded and described as follows:
TRACT TWO: Beginning at a 3/4 inch iron pipe found on the norther right-of-way line of WV County Route No. 21, corner to Jo Anne Blackburn Myles (DB 423, Pg. 521 ); thence leaving said Myles and with the northern right-of-way line of WV County Route No. 21, N 70-41-47 W 78.65 feet to a point on the northern right-of-way line of WV County Route No. 21; thence leaving northern right-of-way line of WV County Route No. 21 and through the property of Stephen J. Myles (DB 454, Pg. 246) with a new division line and with a fence, N 26-15-37 E, passing a fence post found on line at 3.4 feet, in all a total of 98.20 feet to a fence post found; thence continuing with a new division line and a fence line, S 53-35-29 E 63.13 feet to a fence post found; thence continuing with a new division line and a fence line, S 60-31-45 E 16.99 feet to a fence post found on the line of said Jo Anne Blackburn Myles; thence with said Jo Anne Blackburn Myles, S 27-02-00 W 76.61 feet to the beginning and containing 0.156 acre, more or less as surveyed by Greenbrier Surveying in May 2003.
At the time of the execution of the Deed of Trust, this property was reported to have an address of:  HC 37 Box 37AB, Frankford, WV 24938 aka 1311 Anthony Rd Frankford, WV 24938The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS:  $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
