The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 27, 2003, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book No. 494, at Page 445, John Mathena, Jr. and Sandra K. Boggs Mathena did convey unto Eric London, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 25, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Bank of New York Mellon f/k/a The Bank of New York as successor to JP Morgan Chase Bank, N.A. as Trustee for ABFS Mortgage Loan Trust 2003-1, Mortgage Pass-Through Certificates, Series 2003-1 to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Anthony Creek District, Greenbrier County, West Virginia, and more particularly described as follows:
Situated in the State of WV, County of Greenbrier and in the District of Anthony Creek.
Part of that certain tract or parcel of real estate, situate on Wades Draft, in Anthony Creek District of Greenbrier County, West Virginia, more particularly bounded and described as follows:
Beginning at a fence post, situate on the northern most right-of-way line of Wades Draft, a corner to the Wade H. Bennett property, thence leaving Bennett and with the said right-of–way line for four (4) courses; N 28-23 W. 237.04 feet to a point, situate on the said right of way, thence; N. 37-02 W. 56.27 feet to a point, situate in the said right- of-way lie, thence; N. 49-49 W. 163.07 feet to a point, situate on the said right-of–way line, thence leaving the said right-of-way line and through the John Mathena property; N 21-10 E. 1162.04 feet to a 15- inch Chestnut Oak, found situate, situate on top of ridge a corner the Monongahelia National Forest, thence with the Forest Service line; S. 19-31 E. 1060.96 feet to a standard Forest Service monument, stamped 17-512, found, situate near the bottom of the said ridge, a corner to the Wade H. Bennett property, thence leaving the said Forest Service and with Bennett line for three (3) courses; S. 43-53 W. 412.94 feet to a Fence Post, situate in a fence line, thence; S. 28-42-E 120.74 feet to a 16-inch White Oak, found, situate in the said fence line, thence; S. 69-58 W. 205.49 feet to the point of Beginning, containing 12.85 acres, more or less, as surveyed by James A Thompson PS #895, on January 22, 2003, as shown on plat entitled “Plat Showing the Division of the John Mathena Property” attached hereto and made a part of this description.

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  HC 70 Box 511, White Sulphur Springs, WV 24986 aka 1099 Waids Draft Road White Sulphur Springs, WV 24986.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS:  $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
