The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated February 3, 2006, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 576, at Page 263, Charles W. Phillips and Brooke E. Phillips did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on
Thursday, September 8, 2016,
at 8:30 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, sit-uate in the Alderson District, Greenbrier County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in Alderson Municipality, Greenbrier County, West Virginia and more particularly bounded and described as follows:
Beginning at a 1/2″ iron pipe set, at the Intersection of Maple Avenue and Virginia Street; thence with Maple Avenue N 74-00 W 150.11 feet to a ½” iron pipe set, on the east side of an alley; thence leaving Maple Avenue and with said alley N 20-44-30 E 126.47 feet to a ½” iron pipe, set on the south side of another alley; thence with said alley; S 74-00 E 150.11 feet to a ½” iron pipe set, on the west side of Virginia Street thence leaving said alley and with Virginia Street S 20-44-30 W 126.43 feet to the beginning and containing 18,916 square feet more or less, as surveyed by Harvey B. Neal of Lewisburg, West Virginia in April 1996 and as shown on a plat.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 307 Maple Ave., Alderson, WV 24910.
AND BEING the same real estate which was conveyed to Charles W. Phillips and Brooke E. Phillips by deed dated February 3, 2006, from ABN AMRO Mortgage Group, Inc., and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 503, at Page 761. AND FURTHER BEING the same real estate which was conveyed to Brooke Phillips, now Brooke Ballard by deed dated October 2, 2014, from Charles Phillips, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 570, at Page 568.
The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS:  Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
