TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 12, 2006, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50206406, in Book No. 5020, at Page 6406, Jill Amanda Lester and Gregory Scott Lester did convey unto Philip Hereford Kanawah County, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 27, 2013 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on January 8, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Sophia District, Raleigh County, West Virginia, and more particularly described as follows: The surface and any appurtenances thereunto belonging of that certain tracts or parcels of land situate near Sophia, Sophia District, Raleigh County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a wood post in the western right-of-way line of West Street, said post being the southeast corner of Parcel 190 Tax Map 1 and the northeast corner of Parcel 192 and the herein described tract; thence along said right-of way for the next three calls: S 10 f 53′ 53″ E 43.99 ft. to a point; S 06 f 26′ 19″ E 76.51 ft. to a point; S 02 f 01′ 06″ E 19.25 ft. to a point in the center of Soak Creek; thence along said creek N 87 f 00′ 27″ W 157.29 ft. to a point; thence along the eastern line of Parcel 100 Tax Map 1-A and along a fence line N 01 f 42′ 39″ W 121.47 ft. to a gate post; thence along the southern line of Parcel 190 Tax Map 1 N 86 f 27′ 58″ E 143.40 ft. to the point of BEGlNNING and containing 0.45 acre or 19,760 sq. ft. more or less, as shown upon a map entitled “Map Showing Parcels 193 & 192 T.M. 1 & 114 Tax Map 1-A West Street & State Rte. 12 Sophia Dist., Raleigh Co., WV” by Appalachian Engineering & Surveying, Inc. dated 9/24/02 rev. 10/3/02, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Map File 4, at Page 102. And being the same property acquired by Gregory Scott Lester and Jill Amanda Lester, husband and wife, by Deed dated December 27, 2005, from Michael W. Upton and Lora L. Upton, husband and wife, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith. A copy of any notice of foreclosure sale shall be served on Grantors by certified mail, return receipt requested at the following address: P O Box 1578, Sophia, WV 25921, or at such other address as may be given to Lender in writing by Grantors subsequent to the execution and delivery of this deed of trust. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 125 West Street, Sophia, WV 25921. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
