TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 14, 2010, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2010000777, in Book No. 853, at Page 512, Timothy T. Murray and Kathy V Murray did convey unto Vance Golden, Attorney, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 24, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FEDERAL NATIONAL MORTGAGE ASSOCIATION to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on October 19, 2016 at 4:00 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Plateau District, Fayette County, West Virginia, and more particularly described as follows: That certain lot or parcel of land situate in Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at a T-rail, found, common point to Mackey (DB 443 PG 63) and Boone East Development Co (DB 551 PG 432); thence running with Boon East Development Co, S 12 f 44′ E, 249.89 feet to a rebar found, common point to Boone East Development Co and Murray (DB 568 PG 3); thence leaving Boone East Development and running with Murray, S 87 f 09′ W, 196.67 feet to a rebar found, common point to the aforementioned Murray Tract and another Murray tract (DB 554 PG 412) of which the herein described tract is a part of; thence running with a new lines through the second mentioned Murray tract for the following two (2) calls, N 25 f 30′ W, 384.61 feet to a rebar set; thence N 67 f 21′ 30″ E, 169.62 feet to a rebar set on common line to Murray and Fredericks (DB 262 PG 348); thence running with Fredericks for a part of the way and then Mackey, S 43 f 21′ E, 218.70 feet to the point of beginning and containing 2.00 acres, more or less, as shown on the plat or map entitled, “Plat of Survey for Timothy T & Kathy V Murray showing a 2.00 AC Tract” dated October 2004 as surveyed by Land Design Group, LLC. There is further reserved a 30′ right of way and easement across and through certain secured property as follows: Beginning at a point on the northern most right-of-way line for Beech Bottom Road, said point bearing S 87 f 06′ E, 15.13 feet from the eastern most point along Beech Bottom Road of the Murray (DB 568 PG 3) tract, of which herein described easement crosses; thence running 15′ each side of the following described centerline, N 10 f 31′ W, 396.87 feet to a point; thence N 31 f 06′ W, 166.43 feet to a point on the common line to the aforementioned Murray tract and another Murray (DB 554 PG 412) tract, said point being N 87 f09′ E, 37.12 feet from a rebar found as shown on the plat or map entitled, “Plat of Survey for Timothy T and Kathy V Murray showing a 2.00 AC tract” dated October 2004 as surveyed by Land Design Group, LLC. And being part of the same property acquired by Timothy T. Murray and Kathy V. Murray, by corrective deed dated November 10, 1998, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 554, at page 412. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 187 Beech Bottom Road, Oak Hill, WV 25901 aka 353 Beech Bottom Road, Oak Hill, WV 25901. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
