The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 1, 2016, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 201600011164, in Book No. 1154, at Page 538, Adam L Postlethwait did convey unto Larry F. Mazza & Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 17, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Specialized Loan Servicing LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on
July 30, 2019 at 12:30 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Farmington Lincoln District, Marion County, West Virginia, and more particularly described as follows:
All of the following described parcels of real estate situate within the Town of Farmington, Lincoln District, Marion County, West Virginia, being Lots No. 4 and No. 41 in the Fox Addition to said Town of Farmington, a map or plat of which said Addition is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 204, at Page 495, and more particularly bounded and described as follows:
Lot No. 40: fronting on Anderson Street in said Fox Addition 55 feet, thence in a Southeasterly direction and with the line of Lot No. 39 of said addition a distance of 133.84 feet to Robinson Street of said Addition, thence with said Robinson Street a distance of 33.17 feet to corner of Lot No. 41 of said Addition, thence with said line of Lot No. 41, in a Northwesterly direction a distance of 122.28 feet to said Anderson Street.
Lot No. 41: In said Fox Addition of said Town of Farmington and adjoining said Lot No. 40 above described, fronting on said Anderson Street a distance of 50 feet and extending back with the line of said Lot No. 40 a distance of 122.38 feet to said Robinson Street of said Addition, thence with the said line of said Anderson Street a distance of 50.5 feet to corner of Lot No. 42 of said Fox Addition, thence in a Northwesterly direction and with the line of said Lot No. 42 a distance of 155.35 feet to Anderson Street.
Ownership of the above described parcels is made subject to any and all prior mineral reservations, rights of way easements, reservations, terms, and conditions previously set forth and/or reserved in the chain of title.
Reference is hereby made to the foregoing instruments, maps, plats, declarations and such other instruments recorded in the aforesaid Clerk’s Office, for a further and more particular description of said real property.
Being the same real estate conveyed unto of Adam L. Postlethwait and Amber D. Postlethwait from Grace E. Atkinson and Hunter F. Gilley, Jr., which deed is dated December 18, 2012, and of record in said Clerk’s Office in Deed Book 1125, at Page 425. The said Amber D. Postlethwait conveyed all of her right, title and interest in and to said real estate unto Adam L. Postlethwait by deed dated August 26, 2016 and to be recorded simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4221 Anderson St, Farmington, WV 26571.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
