The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated February 4, 2013, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 121370, in Book No. 710, at Page 229 and modified in Document No. 238687 in Book No. 766, at Page 178, Diane Allison Cole did convey unto William D. Goodwin, Trustee(s), certain real property des-cribed in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 2, 2017 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lewisburg District, Greenbrier County, West Virginia, and more particularly described as follows:
All of those three certain tracts or parcels of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in Lewisburg District, Greenbrier County, West Virginia and more particularly described as follows:
Parcel One (1): Being all of Lot No. 50 A, of the Revised Lots 50 and 51 of Maple Grove Subdivision, as shown upon a map thereof, which map is of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 316, at page 259, and more particularly described, as follows:
Beginning at an iron pin set at the common front corner of Lot No.51 of said Subdivision at the intersection of a 40 foot street and a 25 foot street, as shown on the map of said Subdivision, of record in said Clerk’s Office in Map Book 3, at page 1; thence with the Wline of said street, N 22-50 E 100.00 feet to an iron pin at the common front corner of Lot Nos. 49 and 50 of said Subdivision; thence with the common division line between Lots 49 and 50, S 67-30 E 98.30 feet to an iron pin; thence running through Lots 50 and 51, S 22-25 W 99.98 feet to an iron pin in the northerly line of said 25 foot street; thence with the northerly line of said street; N 67-30 W 99 feet to the place of beginning.
Parcel Two (2): Beginning at an iron pipe in the Eastern R/W of Stacy Street, a corner to Robert Nickell, thence leaving Nickell and with said R/W N 22-50 E 50°00 feet to a point; thence through the property of George L. Lemon S 67-10 E 99.00 feet to a point; thence S 22-50 W 50.00 feet to an iron pin, a common corner to William Igo and Robert Nickell; thence with said Nickell N 67-10 W 99.00 feet to the place of beginning and containing 4,950 square feet, more or less, and shown on plat entitled “Plat Showing the Property of Robert A. and Joanne. Nickell”.
Parcel Three (3): Beginning at a 5/8″ iron pipe set in the Eastern R/W of Stacy Street, corner to Robert A. Nickell; thence N 22-50 E 10.00 feet to a 5/8″ iron pipe set; thence with a Southern boundary line of Jean Damrell S 67-10 E 98.81 feet to a 5/8″ iron pipe set; thence S 22-22-30 W 10.00 feet to a point corner to Cary D. Stanley; thence with the boundary of Nickell N 67-10 W 98.85 feet to the place of beginning and containing 988.50 square feet, more or less.
The aforesaid real estate is the same as that conveyed to the Grantor from Britton L. Baker, by deed dated November 20, 2012, to be recorded prior to or simultaneously with the recordation of this instrument.
Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed.
For Purposes of West Virginia Code §38-1-4, any notice of Trustee’s sale shall be mailed to the Grantor at the following address (or such address subsequently given to Lender in writing by the Grantor): 313 Stanley Avenue, Lewisburg, WV 24901.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: RR 2, Box 296G, Lewisburg, WV 24901.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
