The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 8, 2015, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 210985, in Book No. 749, at Page 258, Kenneth E Mandeville and Brittany L Mandeville did convey unto William D. Goodwin, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 9, 2019 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
January 27, 2020 at 12:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto be-longing, situate in Meadow Bluff District, Greenbrier County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of land that fronts on the north R/W of Kieffer Road, W.V. Rt. 8, and is subject to all WVDOT R/W, utilities, easements, a current title report, the land is described by adjoining owners names-hence all lines are a compromise, Meadow Bluff District, Greenbrier County, West Virginia, and more particularly described as follows:
Beginning at a point (no roof bolt found) a comer on the north R/W Kieffer Road, W.V. Rt. 8, subject to all WVDOT R/W, a corner to James Lilly (DB 511/326) being referenced by a nail set 530.44 W 2.00 from the corner thence with said R/W N 63° 46’ 58’ W 113.28 to a ½iron pipe found, a corner to Mrs. Thorp (see exceptions over deed 23,100 sq. ft.) thence with Tharp 2 lines all compromises N 29° 20’ 23”E 192.55 to an iron pipe found, south of a branch N 55° 20’ 12”W 103.56 to a 35 tall doxle thence with Tharp, crossing first the branch, then Beaver Creek following a flagged line N 30° 34’ 33”E 65.41 to a center of a marked 4”-6”maple north bank Beaver Creek a corner to Tharp and J&C Deitz (DB 511/326) thence with Deitz generally near an old fence and north side of Beaver Creek S 65°21’ 21”E 232.18 to a fence post Thence crossing Beaver Creek generally with old wire fence S 31° 31 08”W 117.20 to (an iron pipe found on line at 105.62) a total distance to a point on corner to Deitz and James Lilly; thence with Lilly N 50°22’ 32”W crossing a small branch, 8.23 to a 3’ tall roof bolt, thence with Lilly compromise line S 30° 44’ 26”W 164.80 to the beginning containing 0.92 Acres, subject to all agreements, as surveyed by Mountaineer Land Surveys, J. Brad Smith, P.S. in May 2015. And being the same real property conveyed unto Kenneth E. Mandeville and Brittany L. Mandeville, husband and wife, or the Survivor, by deed dated April 1, 2015, from David A. Huffman, said deed not yet of record.
Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2825 Kieffer Rd, Crawley, WV 24931.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
